BREAKING NEWS - CA AG Says Scandal Money is OHV



The Recreation HQ wants to share this breaking news regarding the 54M in the CA State Park scandal that broke last summer.   The California Attorney General, Kamala Harris, just released the results of her investigation into State Park’s reporting and use of special funds.

The report appears to conclude that over 34M of those monies belong to the OHV Fund.   As many of you know, the legislature reconvened in August to address the scandal.  Yours truly and several other OHV leaders met with legislators in Sacramento and in their Districts to petition them to allow those funds to be used to restore the local assistance grants program to previous levels.  Before the scandal, the legislature had capped the grants program at 10M (compared to 21-26M in previous years).  HQ believes the legislature's new post-scandal bill allows for those monies to be potentially used to restore the grants program to previous funding levels and to lift the 10M cap.

Green Park Groups Fear Blowback from DPR Scandal

The Recreation HQ believes the article published today by the SacBee regarding how certain Park-related non-profits is really on target.

I believe the CA Parks Foundation and other park-related non-profits should be afraid of public outrage and blowback from the OHV community because of their Sustainable Parks Initiative that was based on a lie.  That plan had as its “foundation block” the complete evisceration of the OHV Program and its grants program to federal and county partners.

I personally believe that certain non-profits are in fact nothing more than stealth branches of the Department of Parks and Recreation.  This scandal proves that abuse by Parks of the OHV Trust Fund has become institutionalized and has been an accepted way of doing business.

Further proof of OHV being nothing more than a political football to be kicked around by green groups and their friends at DPR was also highlighted in a 2005 audit of the program by the Bureau of State Audits.  *They only scratched the surface in my opinion.

That report had a lot to do with OHV leadership pushing for a complete overhaul of the OHV program that was set to expire on Jan. 1, 2008.  That effort in 2007 resulted in SB742, the new CA OHV Program.

CA Trust Fund Raid On Major Sports Talk Radio




HQ’s Don Amador was on Bike Week Radio on June 24, 2012.  The main topic was the ongoing raid by the CA legislature of OHV fuel tax monies and the impacts it will have on the grants program and even the program in general.


Topics and themes included the CA Dems declaring war on the GOP and how OHV is being caught in a political perfect storm.   And, how other user-pay/user benefit programs are being hit and how important it is for all motorcyclists and OHV users to get engaged in the political process.

All-Hands-On-Deck Letter Campaign to Gov. Brown ... and that means EVERYBODY



The Recreation HQ wants to urge all affected parties (riders, govt. works, resource professionals, law enforcement, conservation groups, rural businesses, aftermarket, OEMs, and other OHV stakeholders) to FAX in letters today and get your friends and family to do the same.

This is an all-hands-on-deck alert.   I know many of you have already sent in letters to the legislature and the Governor… but do it again!  We need letters from folks out-of-state who come and recreate in CA as well

Eco Groups Oppose Raid on OHV Trust Fund


This Whole Thing Stinks!

As the CA Trust Fund War continues, HQ believes that it will be important for OHvers to eventually ask the Governor to veto/oppose any transfer from the OHV Trust Fund to the general fund or to other non-SB742 approved activities or uses.
HQ wants to commend Trout Unlimited and other conservation groups who joined with the OHV community in a joint letter (in a similar fight in NM) asking the New Mexico governor to veto any transfer of OHV funds to the general fund.

HQ does not believe there is broad support among mainstream environmental or conservation groups for the California Parks Foundation’s plan to steal OHV Trust Fund monies that will gut the local assistance grants program to our local, county, federal, and NGO partners.

Dark Days Ahead for CA OHV Program

The Recreation HQ is not happy about what happened today at the Assembly Budget Committee hearing.  By now, many of you already know that Assemblyman Jared Huffman (D-Petaluma) championed the agenda of the far left environmental movement to defund the OHV grants program to the FS, BLM, and county/city parks so they won’t have the money to maintain trails and facilities.   After which they will complain about the lack of funding to maintain trails and then sue the agencies to force them to close the trails.

This is actually one of my darkest days in land-use advocacy in the last 22 years.  It appears the anti-OHV groups have a choke-hold on an all too willing legislature.  It also appears the city/urban legislators have declared POLITICAL AND ECONOMIC WAR on rural parts of the state.
Shame on the Parks Foundation for their part in this scheme.
Just where this ends, I don’t know.  Be assured that the fight is not over, but we are at the bottom of one of the longest political hillclimbs I have ever faced.  Stay tuned for further alerts and action items as this plan moves into conference.

HQ ACTION ALERT - Stop the Raid on the OHV Grants Program

Having just come back from meetings in Arizona (a state with a balanced budget and a lot of riding opportunities), I can’t tell you how angry I am about this ongoing effort by the legislature (with support from some green NGOs) to eviscerate the OHV Grants Program.
If you haven't already made your calls to stop the almost annual attempt to rob California's OHV fund, maybe this article from Townhall Mag will motivate you.  
Townhall reports on an Associated Press investigation of the $15 million collected from the "California Memorial Scholarship Program," advertised by the California Department of Motor Vehicles as helping the children of Sept. 11 victims.  AP found only a small fraction of the money went to scholarships. While 40 percent has funded anti-terror training programs, $3 million was raided by Gov. Jerry Brown and his predecessor, Arnold Schwarzenegger, to plug the state's budget deficit.

California is in a severe budget crisis. Before the state falls into a fiscal abyss, real solutions must be found.

Real solutions do not include raiding trust funds or robbing kids of 911 victims. These gimmicks won't solve California's budget deficit.  They never have nor will they ever work.
OHV users will not tolerate what is essentially a tax on the privilege of owning an OHV. We've paid those taxes. My contribution to the OHV trust fund is not to be used for any other purpose.

HQ wants to thank all those riders and groups who helped rally the troops for the May 9 hearing on the proposal by two state senators to gut the OHV grants program.  Your calls raised the temperature on this ill-concieved plan so the legislature postponed it until May 23.

You and your friends must do the same thing for the hearing on May 23.

Here are some key bullet points to make when talking with your legislator:

              OHV Grant Program is a program that works.  The clarity is such that we understand the funding; we know where the money is coming from and how that money is spent.

              It works and it works effectively.

              40 years ago, Republican and Democrat legislators realized that people within the Parks System did not appreciate off-highway vehicle recreation.  Consequently, OHV was given some autonomy within Parks and an OHV Division was created.

              These visionary leaders wanted a strong, organized program that included law enforcement, the remediation of land and education with an understanding of where you can recreate legally.  It works.

              It makes no sense to move the money from the OHV Trust Fund to Parks.

Ask your legislator to oppose Senator Simitian's proposal to take trust fund monies from the OHV Trust Fund.  Remind them these are funds are generated 100% from the users who recreate off-road.

Dear Senator Simitian:

I write to you today as a California native and a strong supporter of the California Off-Highway Vehicle (OHV) Program. And, I urge you not to betray the public “trust”  by taking $21 million dollars of  user-pay/user-benefit monies from the OHV Trust Fund and diverting it into State Parks.

As a teenager in the late 1960s-70s, I remember filling out a state gas tax refund form where I got a refund from the state treasurer based on the amount of fuel I used when driving my OHV off-road (non-paved dirt roads). I also remember the promise made to me by the proponents of the Chappie-Z’berg Act of 1971 (that established the California OHV Program) that they would use these dedicated “trust” funds to manage motorized recreation. I trusted them.

Over the years, that trust has been betrayed on a number of occasions by both Republican and Democrat officials. In fact, there have been two lawsuits filed by the OHV community that successfully challenged the state government’s legal authority to raid the OHV Trust Fund.

As a member of the negotiating team (OHV, environmentalists, legislature, Governor’s Office) that met throughout the summer of 2007 to hammer out SB742 (the new OHV Program), I remember the group worked hard to make sure that protecting the “trust” in the OHV Trust Fund was a key statutory tenet of that legislation.

Today, I urge your committee to not betray the public-trust again by taking OHV money that is not yours to take.

HQ ACTION ALERT - Congress Attempts to Steal OHV Money from RTP

Earlier this year, I testified before the California State Legislature urging them not to steal money from the “user-pay/user-benefit” CA OHV Trust Fund. They were informed such an action would create an even greater distrust of state government if they did so. But as many of you already know, they took votes to approve the theft when pro-trail politicians were absent (using the sanitation facilities for 5 mins.) from the committee.

SACBEE - Quit Taking Money From the OHV Trust Fund?

According to D36’s Dave Pickett, over the 40 year history of the program over $200 million dollars has been stolen from the OHV program. I remember back in the early 70s when the OHV program was invented. Back then, environmentalists and the legislature told riders that if you let us take your state off-road fuel tax refund… we could have our own user-pay/user-benefit self-funded program

Well after recently doubling the green sticker fee it now looks like enviros and some legislators want to break that promise and continue stealing money from our Trust Fund.

Because of an unquenched thirst for funds from one of the only self-funded state programs, the enviros and some in the legislature feel a sense of entitlement from a program where riders already feel double-taxed and betrayed by the long history of “loans.”

Rather than steal money from the OHV program, PEER and some legislators should look for ways to make regular state parks more relevant, cost-effective, and self-funded.

Regarding the $200 million dollars - HQ wants to cite a quote from a popular and funny TV ad…”It’s MY money and I want it back.”

HQ says quit taking our money and pay back what you have stolen. And, stay off the slippery slope of interagency money shifting.

HQ UPDATE - OHVers Testify at March 14 OHMVR Commission Meeting

The Recreation HQ wants to thank all members of the OHV family for attending the special OHMVR Commission meeting yesterday in Sacramento. HQ believes the commission admirably fulfilled its duty to represent OHV recreation by taking public testimony from a wide array of interests.


This was the best attended commission meeting in the last 3 years and it showed the high level of concern by the OHV community regarding the $10 million dollar “shift” out of the OHV Trust Fund to the General Fund and the potential loan of $21 million dollars from the OHV Reserve Fund.

HQ noted four reoccurring themes in most of the public testimony and commission comments.

1 – Stealing money from the OHV Trust Fund violates the public trust
2 – Stealing money from the OHV Trust Fund is a double tax
3 – Stealing money from the OHV Trust Fund is illegal
4 – Stealing money from the OHV Trust Fund violates the legislative intent of SB742

After an hour or two of public testimony the commission voted to send a letter to the Governor and legislature regarding their opposition to taking the money which violates the public “trust” in the Trust Fund. They are also going to send a letter seeking to resolve the fungible issue based on what many feel is an illegitimate decision made by the Legislative Analyst’s Office in 2009.

After taking a short break, the commission reconvened and took additional public comment on non-agenda issues. BRC’s Don Amador updated the commission on some recent developments regarding Clear Creek. Those updates and issues included the congressional hearing last week where the BLM Director was asked about the closure of Clear Creek, the commission and public should receive an update or status report on the OHMVR Division’s Asbestos Study, and the FEIS is on the brink of being published in the Federal Register.

HQ believes the commission is considering a meeting in the Hollister area in the next 3-4 weeks to review the Clear Creek issue. That is a good thing.

CA OHV Program Takes $10 Million Dollar Hit - The Fight Continues



The Recreation HQ wants to thank all of you who sent in letters, made phone calls, and attended meetings. As you know, there was an effort to gut the entire CA OHV Program. That reality could have closed SVRAs, shut down the Division, and ended the grants program.

Over the last 3 weeks, you let your legislators know that you did not want them to steal money from one of the very few successful user-pay/user-benefit programs in the state. You also asked them to put the “Trust” back in the OHV Trust Fund.

Based on the vote yesterday by the Budget Conference Committee... that group appears to have heard your voice. As some of you know, they voted to “shift” $10 million dollars out of the OHV Trust Fund ($5 million from the grants program and $5 million from the Division/Support program). We will have to see if "shift" means a loan or a take.

Based on the fact that we were looking at a complete annihilation of the OHV program, HQ feels this is somewhat of a victory. However, we need to be careful about calling it a victory because the war against the OHV program is far from over. We have yet to see if the Governor will actually sweep out $21 million dollars from the OHV reserve fund.

Also, other attacks against the program could occur between now and when the Governor signs this budget later this spring. I think it is interesting that we have not seen the “list” of proposed state park units that will be closed. My feeling is that state parks was waiting to see how much they could steal from us before posting that soon to be infamous list of park closures.

As it stands right now according to my best analysis… here is what the OHV program looks like for the 2010-2011 budget (remember the Gov. and legislature will have to fight over the 2011-2012 budget in a few months).

$27 million for the Division/Support Budget/SVRAs

$22 million for the Grants Program

HQ urges you to stand ready for the next fight. The ongoing battle to protect our OHV program will be of historic proportions this year. Your continued support and activism will be important.

A California Native Sends Letter to Budget Committee to Protect the "Trust" in the OHV Trust Fund


The Recreation HQ wants to thank all the OHVers (and even those few from the environmental community) who have already sent in letters and/or made phone calls to state government officials urging them not to raid the OHV Trust Fund.


HQ also wants to thank all the OHV groups such as AMA, D36, BRC, ROC, ARRA, CORVA, CAL4, D37 and many others who either sent in letters on company letterhead, posted alerts, and/or attended hearings.

As the Budget Conference Committee meets over the next few days, HQ believes it is important now for you to send in your personal letter on this subject NOW.

DEFCON ONE Alert to CA OHV Community - Stop Weekend Raid on OHV Trust Fund

CA OHV COMMUNITY PLACED ON DEFCON ONE ALERT STATUS THRU WEEKEND

After the California Budget Conference Committee’s discussion today about the fiscal future of the CA OHV Program, the Recreation HQ is issuing its first DEFCON ONE ALERT.


Folks, the Committee postponed a vote to steal the money today but will be meeting between now and over the weekend until they decide how much money they want to take from the OHV Trust Fund. I heard from one government staffer who witnessed bogus testimony from the California Legislative Analyst’s Office staff about how they have a right to steal dedicated funds. This person said it was the most embarrassing display of bad government they had ever seen.


HQ believes these proposals to steal money from the OHV Program is a gross violation of the public trust and betrays both the spirit and intent of SB742. How can they ever ask the OHV community and OHV leaders to work with them in a collaborative manner if they do this? Nobody I know will ever trust them including me.


This DEFCON ONE ALERT is being issued because HQ believes that both the Grants Program (trails, restoration, law enforcement, and safety) and the Division (SVRAs, grant staff, scientists, other professionals) are now both equally at risk (before they had just talked about gutting the Division side of the program).


HQ is asking that you share this information with your local county supervisors, sheriffs, FS, BLM, and other grant recipients and ask them to contact the Budget Conference Committee Members AND their own Assembly members, State Senators, and Governor to petition them to honor the OHV Trust Fund. It will be the rural counties and users that get hurt the most if the OHV Trust Fund is sacked.

Thanks to the California Channel you can view the hearing. Some riders ask what do you professional OHV advocates do for us? Well, here is one time where you can see us standing up for you in front of a legislative body that has proposed to borrow (some call it stealing) or reallocate (fungible) OHV Trust Funds for other non-OHV uses.

Starting at about 1:56 into the video you will see the OHV hearing segment. Shortly after it starts you will see state park officials defend the OHV program. Then you will see my good friend Reed Addis (green lobbyist) support the assembly staff’s recommendations to steal money from the OHV fund. Then you will see Nick Haris (AMA), Terry McHale (OHV Lobbyist), Don Amador (BRC), Dave Picket (D36) and representatives from CAL4WD, RTF/Pirate4x4, ROC, and others. You will also see the post testimony discussion by the elected officials. There are a number of interesting comments. Watching this video is an important lesson in why OHV has to be involved in the legislative and political process.

CODE RED ALERT - OHV Trust Fund Under Attack in Sac - Letters Needed by 9:30am Today



HQ is sending out a “broken arrow” alert, which means “all hands on deck” -- our OHV program is under attack. Your help with a letter or by attending the Assembly Budget Committee #3 Hearing today at 9:30 a.m. in Room 437 at the State Capitol is urgently requested.


Thanks to a heads-up by my good friend, Nick Haris (AMA), late yesterday, HQ found out that the Assembly Budget Committee #3 Hearing on Monday February 7 had said they would not look at OHV budget issues until sometime in May. Suddenly on Wednesday, Nick finds out that the committee plans to review OHV budget issues TODAY!

One of the most outrageous proposals by the committee is to consider most if not all of the OHV Trust Fund to be “fungible.” In simple terms… that means that the legislature or bureaucrats can use that money for almost anything they want including non-OHV issues. Yes folks, that means we would not have an OHV program.

Secondly, they want to take $5 million dollars to hire state park rangers to patrol a yet to be determined list of “closed parks” to protect them from an assumption that there will be illegal OHV activity there. If there is trespass, that is a local crime issue that should be handled by the sheriff. If they are going to hire park rangers to patrol closed parks, why not have the park rangers patrol an open park?

I am asking you to FAX or email the Assembly Budget Committee # 3 today by 9:30 am. TODAY.  I will be there in person to testify. If you cannot attend, I believe they will be broadcasting it on video feed (check assembly website for link)

RE: Feb. 10 Hearing - Concerns About Impacts to OHV Program


Dear Chairman Gordon and Committee Members:

As a native of California and a strong supporter of the California Off-Highway Vehicle (OHV) Program at State Parks, I write to your committee with strong concerns and objections to a number of proposals that could seriously impact the future and viability of this unique “user-pay/user-benefit” state park program.

OVERVIEW:
I was first alerted to your committee’s actions on February 7 and the proposed actions for today’s hearing by a representative of the American Motorcyclists Association. Due to the late notice of your committee’s proposed action, I apologize in advance for any misinterpretation of the facts and figures and commit to further analysis as well as working with your staff on these issues. Trying to weave through the various public documents with little review time was difficult at best.

SUPPORT:

Before stating my concerns, I want to thank the subcommittee for its apparent support of several pro-active and important OHV-related proposals in the Governor’s budget that includes storm water compliance, updates to general plans, land surveys/acquisition feasibility studies, $27.1 million dollars for the local assistance program, and the capital outlay budget.

OPPOSE:

Breech of the Public Trust

BRC urges your committee to reject what we feel is an incorrect informal opinion made by the Legislative Counsel in 2009 that the gasoline tax fees and SVRA entrance fees are fungible which means that up to $75 million dollars of the OHV Trust Funds could be spent by the legislature or state park department for any related or non-related OHV use. As part of the 2007 negotiating team (OHV, environmental, Governor’s Office) for SB 742 the new OHV program, I believe the use of this informal opinion would create a serious breech of the public trust because OHV leadership and state government promised the OHV community that if they would double their vehicle license fees and agree to a substantive environmental restoration program that the OHV Trust Fund would be respected and honored by the legislature. Again, this fungible concept places the entire OHV program in jeopardy and would be in conflict with the legislative intent of SB 742.


Sweeping of the OHV Reserve Fund

Recently, Governor Brown cancelled the proposed sale of 11 state properties and stated that to make up some of the difference his office would sweep special fund reserves. At this point it appears there is $25.6 million dollars in the OHV Reserve Fund. Again, this appears to be a breech of the public trust according to promises made to the OHV community in the process of enacting SB742. BRC believes the sweeping of this fund could also threaten the OHV program’s ability to fulfill its legislative mandate to provide for environmentally responsible OHV recreation in this state.

Appropriating $5 million dollars for “Closed Park” Law Enforcement


BRC believes this action is ill advised and premature. There is no list yet that is available to the public. The 2005 Bureau of State Audits Report on the OHV program found these types of “taking” to not be in compliance the legislative intent of the OHV program. As you know, these funds have been directed by the legislature to be used exclusively to support legal OHV opportunities. BRC believes the “assumption” that OHV crimes will occur in closed state parks is speculative at best. Secondly, if there is OHV trespass it is a local crime issue best handled by the sheriff’s department. It does not make sense to hire state park rangers to patrol a closed park. If you hire park rangers, you should have them patrolling an open park.

Also, there are a number of rural state park units that have or have had legal OHV opportunities such as Tolowa Dunes, Red Rock Canyon, and Anza-Borrego. If those units or similar units are on the closure list, state parks should work with the OHV program or county parks to see if they could operate them and keep the units open for public use. Having a park that is relevant to the local and visiting public could help keep it in business.

Summary:

BRC urges the committee to slow down and take more time to review the serious implications of our aforementioned concerns on both the short and long term viability of the OHV program in California. Let’s keep our promises that we made to the OHV community in SB 742.
