Big OHV Victory - Court Dismisses Carnegie Lawsuit!!!

The Recreation HQ is very happy to announce that the bogus lawsuit filed by hard-core anti-OHV groups during the Christmas Season of 2009 has been dismissed with prejudice by the courts.

I know many of you attended the Christmas Rally in 2009 to help keep Carnegie open for families to enjoy during the Christmas/New Year’s Holiday.

From what HQ hears from its S.F Bay Area legal sources is that Karen and Company got stuck with paying most of their own legal fees (about 500k).  What a change of course in our legal system when a lot of the time… the taxpayers get stuck with paying for all the tabs created by eco-lawsuits.

I wonder if the courts are being to smell the green  “Skunk at the Party” and are realizing that politically-based lawsuits have worn out their welcome in the legal arena.  Only time will tell.

Faux Outdoor Groups Have No Place in Land-Use Debate/Political Process

           The Famous Carnegie "Eco-Hoax" Fish - The only fish that has ever been in the tiny stream


Over the last few years, HQ has written about faux OHV groups who have been created by far left green groups as a way to try and confuse general recreationists and elected officials. One of HQ’s blogs exposed several of these groups as nothing more then a proverbial “Skunk at the Party.”

Based on my experience with fake OHV groups, it came as no surprise when I read over the Thanksgiving Holiday about “Montana Hunters and Anglers” - a faux sportsmen’s group that is nothing more than a political attack dog - seeking to take out Congressman Denny Rehberg (MT) in the 2012 election.

OHVers in the SF Bay Area got their dose of a closure oriented “sportsmen’s” group several years ago when the California Sportfishing Protection Alliance filed a suit to “protect fishing” at the Carnegie OHV Park. Trouble was that there have never been any fish in the tiny intermittent stream that runs in the center of the park. It was totally a faux issue much like the effort being used to unseat Congressman Rehberg.

Working with legitimate environmental and conservation groups is something I do on a regular basis. However, faux OHV and hunting/fishing groups should have no place in the land-use debate or political process.

Algore's Fraud a Thon Loses Nobel Scientist

Based on some PMs sent to HQ, it does not look like Algore’s Eco Fraud-a-Thon converted any new disciples. In fact, it looks like his climate change crisis mongering lost his movement a Nobel Prize winning scientist.

HQ believes that Algore’s sermons on climate change are just as morally bankrupt as Solyndra. He should abandon his “crusade” (oh yea, the Crusades did not work out that well either) and man-up to his ill-conceived theory.

If Algore still has his Honda 305 – from his college years - stored somewhere on one of is properties, HQ suggests that he freshen that bike up and take it for a spin. That ride might just be what he needs to clean out all the green junk in his brain.

It appears that our favorite green hypocrite is going to try one more time to convince you with his apocalyptic eco-hype that the world is about to end if you don’t quit driving your car (or dirt-bike, ATV, UTV, or 4WD) and flying on jets (remember it is OK for him to drive a SUV or fly on a jet because he is important and you are not).

According to the Reuters report, Algore wants use of your social media networks to bombard your friends with his eco-BS.

For those of you who missed being at this event, the Recreation HQ is proud to be able to share a clip from the December 28, 2009 Save Carnegie SVRA Rally. This video was shot by Bungee Brent – Dr. Xtreme. We owe him a great big thank you for capturing the rally on a DVD where over 1,000 off-roaders from as far away at Lake Tahoe came to rally in support of the park and in protest of anti-OHV groups who file politically motivated lawsuits that have nothing to do with the environment or science.

Jan. 11 - Legal Fog Hangs Over Carnegie Crisis


The Recreation HQ has received several emails from riders who want to know what exactly is going to happen at Carnegie on the magic date of January 11, 2010.

The General has worked hard to sift through the rhetoric in order to inform Carnegie fans if the park will stay open or not until the water permit has been approved.

As some of you know, OHMVR has been ordered by the appellate court to submit its written argument on January 11, 2010. But that is where the clarity ends and the uncertainty of the park begins.

Based on my understanding of the appellate court (which is usually more moderate than a single activist judge), it can order any of the following actions:

After reviewing the state’s written argument, the court could decide to withhold any decision until after oral arguments are heard. However, the timeframe for them hearing any oral arguments could range from a few days up to several weeks or a month. What is uncertain is what the court would do regarding the park being open during the review period. It could remain open (a likely scenario) or the park could be closed.

Another option would be for the court to immediately review the argument that day and order the park to remain open or closed based on that review. Or, the court could give itself a certain timeframe (days or weeks) to review the arguments and render a decision during which time the park could remain open (a likely scenario) or the park could be closed.

Also, there are many other options as well that may or may not be just as convoluted.

The point I am trying to make is that nobody (including The General) can predict what the appellate court with do on Monday. It is very likely that the OHV community will not know the open or closed status of the park until 5 p.m. on Monday.

The General will be at meetings this next week (Mon – Thurs) so he may have limited amounts of time to post updates, but rest assured he will do his best. In the meantime, be sure and monitor the OHMVR Official Website for updates. They have worked hard to keep you informed.

New Direction for OHV Legal Interests in 2010?


The Carnegie saga woke up a lot of SF Bay Area off-roaders to the fact that motorized recreation is under a vicious and unrelenting assault by anti-OHV groups (that now include “fishing” organizations).

It has also exposed the soft underbelly of some so-called environmental groups as having an agenda that has nothing to do with “protecting the environment” – but having everything to do with the exercise of political power over their adversaries. (e.g. timber, mining, OHV, ranching, developers, and farmers)

For several weeks, The General has stated he believes off-roaders will see an avalanche of anti-OHV lawsuits in 2010 and beyond based on junk science, crisis mongering, and non-substantive technical violations.

What you won’t see are those same environmental groups challenging aggressive TMR road decommissioning projects that do not have site-specific NEPA documents or worse yet are being worked on with heavy equipment during the wet season (yes, the same wet season when OHV use is either banned or severely restricted). It has been The General’s experience that enviros (and some agency staff) turn a blind-eye to resource impacts if the goal of the project level activity is to CLOSE an area or route to OHV use.

Recreation HQ believes that OHV legal interests should consider filing a lawsuit on federal travel planning projects where there are either gross or technical NEPA violations
or where there are sediment impacts that violate BMPs or other water quality regulations to important salmon (yes, real salmon habitat – not the Carnegie hoax fish habitat) fisheries.

The General is asking the troops to keep an eye open for examples that match the aforementioned scenario as depicted in today’s photograph.

Filing lawsuits against enviro groups or agency bureaucrats based on corruption, dishonesty, or bias - although sounding good - really don’t have much legal merit. However, environmental law suits based on NEPA, water quality, or ESA violations do have merit and maybe that is the type of suit OHV legal representatives should be looking for besides our standard intervention-type legal actions.

The lights were on late last night and then on again at o’dark thirty today at the Recreation HQ. The General was, and continues to be, impressed with the quality, caliber, and sincerity of the riders and supporters who came from as far away as Lake Tahoe to fellowship with the Carnegie off-road family in our time of need.

In my Friday Dec. 18 blog, I said the appeals process would need Divine intervention if it was to be successful in time to keep the park open. Based on the good news yesterday regarding the appellate court’s decision to keep the park open until at least until January 11, I think the many prayers that were offered for that intervention over Christmas were answered yesterday.

Several riders have asked me if I believe in miracles? The answer is YES. Twice in the last year, my life was spared in a miraculous way.

After reading a lot of news reports on the rally (most of which failed to note that this whole lawsuit by the now faux fishing group is based on a hoax), I think this article in the Stockton Record best captures what really happened at Carnegie yesterday (although the reporter mentions Divine intervention he does not credit it as I think he should have)

The Carnegie saga continues and so does the much larger battle for our sport in other riding areas. Future action items will be forthcoming. However, I think it is important for us to take a short pause and be thankful for this miracle. We also need to be thankful for OHMVR leadership and others who worked overtime during the holidays for their part in this miracle. To give thanks, consider a donation to a charity or food bank or some other act of kindness or service.

Besides honoring the work of Dave Duffin and his crew on behalf of Carnegie and honoring the many off-road families who attended the rally, I want to thank all the motorcycle clubs who came out wearing their colors in support of the park. I may be missing a few, but I do remember seeing representatives from the Oakland Motorcycle Club, Hayward Motorcycle Club, TimeKeepers Motorcycle Club, North Bay Motorcycle Club, High Sierra Motorcycle Club, and the California Enduro Riders Association. I also want to thank our 4WD brothers and sisters from CAL 4WD, Pirate 4x4.com, Diablo 4 Wheelers, and several others. If I left any clubs out, I apologize in advance. Things were a bit hectic yesterday.

Was this our own off-road version of a Miracle on 34th Street? I will let you make that call. As for The General and the staff at Recreation HQ – we believe.

ClimateGate, Copenhagen Climate Conf, OHVs, and Ed Begley Jr.


The General had planned to take a couple of days off from the land use battle front to enjoy the Thanksgiving Day Holiday with his family and friends. However upon post –Thanksgiving Day reflections, he feels the need to discuss the ever growing ClimateGate scandal is so important... as to merit a holiday muse.

Also, my recent post on faux OHV groups and eco-hoaxes resulted in The General getting a large number of private emails. Most were complementary, but several challenged my blog’s tone and direction.

As you know, I have long believed the public has been subjected to a large number of eco-hoaxes over the years. But as I told more than one of my skeptics, my greatest contention I have with many “environmental leaders” is the amount and scope of the lies and hypocrisy they will employ to enact their political agenda.

Algore flies around the world on a private jet and then tells us regular citizens that we have to ride bicycles, reduce electricity, and turn down our heaters at the same time as his home(s) is consuming more electricity then some small towns.

In California, several faux environmentalists (I call them that because they are hypocrites) long argued for new science to be used to manage OHVs on public lands. I, on behalf of BRC, supported and worked in the field with researchers, students, agency biologists, and academics to develop new science to help formulate future guidelines for OHV use in spotted owl habitat. What many people don’t know is that those same “environmentalists” tried to kill that project when they feared the results would not match or support their closure agenda.

The results of this almost 10 year project should be out late this year or early in 2010. I don’t know what the results will be, but at least The General, the CA OHMVR program, and a number of OHV clubs had the courage to participate and support a project, the results of which have yet to be published. No such moral fortitude is noted on the faux green side.

As more news outlets and blogs expose ClimateGate and the upcoming farce known as the Copenhagen Climate Conference scheduled to start on Dec. 12, I am reminded of what my dad did when I was a kid growing up in Eureka, California.

Back in the day, he used to chew Copenhagen smokeless tobacco. When he was through chewing he would spit it out since all value of the product had been realized. As more folks object to proposed Cap and Tax Legislation that will dramatically increase our energy bills and devalue our American way of life, maybe it is time for the public to “spit” out the lies and hypocrisy of the global warming scandal onto the ash heap history’s other eco-scams such as the global cooling prophesy of the 1970s or the Alar Scare of 1989.

In my state, I and many others have blown extra insulation in our attics, installed double pane windows, recycle our oil and plastics, plan our trips to the store, and a have employed a plethora of other actions to conserve energy and live responsibly. All that seems to have gotten us is new proposals to increase our electric rates, impose new energy taxes, and more promises of the same.

I do have respect for real environmentalists such as Ed Begley Jr. When he speaks… I listen. He has long practiced what he preaches. He lives in a small house, rides a bicycle, composts his waste, etc.

What I don’t have respect for are eco-hypocrites who practice a form of environmental elitism where they can build homes out of redwood, fly in private jets, use obscene amounts of energy, and develop carbon credit programs designed to line their pockets with millions of dollars.

Be assured, The General will continue to maintain trails, practice common sense stewardship, and promote a responsible OHV land use ethic. What he won’t do is stand by while certain politicians and eco-hypocrites pour wet stuff down his neck and proclaim it is simply raining.
