HQ Mourns Passing of OHV Hero

The Recreation HQ was shocked today when it learned of the passing of Troy Rauh (above photo). Troy was a true trail champion and off-road hero of mine. He was also a member of the Redding Dirt Riders.

HQ DUAL-SPORT/ADVENTURE RIDER/4WD ALERT

The Recreation HQ is issuing an Action Alert regarding the proposal by Yolo County to abandon Road 40. This is a popular motorized access route for dual-sport/adventure riders and 4WDers to access the Knoxville OHV Area from Yolo County. It also provides motorized access for public land non-motorized activities such as camping and hiking at Buck Island, Blue Ridge South, and Fiske Creek.

Yolo County is proposing to abandon Road 40 based on a request from the Homestake Mining Company. Over the years, HQ has received a number of emails from adventure riders who enjoy this route. The public comment period ends January 25, 2012.

HQ Book Review - Energy and Freedom

On occasion, HQ reviews a book that may help recreationists understand the complex world of the Green Conflict Industrial Complex (GCIC). GCIC consists of a collaborative process by which extreme environmental groups work with their counterparts in academia, government agencies, media, courts, and elected office to impose their vision (or nightmare) of how you should live.

Many trail users new to the fight don’t have the time to wade through the many exhaustive literary monuments written on this subject. Lucky for us that noted author and speaker, Marita Noon, has taken the time to pen an easy to read and understand book. Marita takes the reader on a 2-hour journey on how the common thread of “energy control” runs through every issue from the price of fuel to the Northern Spotted Owl.

Her book, Energy Freedom, is a must read for those who are engaged (regardless of your experience) in the current land-use debate. Off-roaders, government agency staff, elected officials, outdoor interests, and even environmentalists will gain insight by spending time with this book.

HQ considers Marita a friend and fellow champion in the fight against GCIC and encourages you to pick up her book and get a good dose of “Energy and Freedom.”

OK you guys and gals, vacation is over and its time to hit trail access issues again. Our good friends over at the Pine Nut Mountains Trail Association have been working hard on a multi-faceted land-use proposal near Carson City, NV. It is what I call your newer 21st Century land bill that should have something in it for all interest groups.

On the West side of Douglas County there is a proposal for watershed conservation-protection and on the East side is a Wilderness proposal. However, right in the middle is the popular Pine Nut Mountains where there is a lot of historic OHV recreation. Off-roaders also come from CA and OR to ride there.

PNMTA has come up with a proposal so that OHV recreation is protected by asking Congress to designate that site as a National Recreation Area where OHV use is a prescribed use. They are asking riders who frequent the area to contact Douglas County officials and the project’s facilitators. Yes, I FAXed and emailed in my letter already – it was easy.

10 - Off-roaders and mountain-bikers unite to fight against several Wilderness bills in UT, MT, and ID.

9 - FOX News does a fair and balanced feature story on managed OHV recreation. It is so interesting and factual that Bill O’Reilly sends his producer, Jesse Waters, to do a follow-up story at the Imperial Sand Dunes and Oregon Dunes National Recreation Area.

8- EPA’s Environmental Justice program adds the protection of OHV recreational access to public lands as new tenet. EPA appoints an OHV representative to their National Environmental Justice Advisory Council.

7- The Forest Service realizes the 2005 Travel Management Rule has created more problems then it solved. The agency withdraws the rule and allows each Forest to decide when to develop travel plans. Trails that meet the Montana 3-State EIS criteria are grandfathered in as “designated” system trails.

6- After Romney wins the GOP nomination; Newt Gingrich changes his position on Global Warming and cuts a new ad with Al Gore where they both embrace the need for “cap and tax” legislation. The video is shot with both men sitting on a bench carved out of old growth redwood to illustrate carbon sequestration.

5 - A major Wilderness organization starts its own “OHV” group. It claims to represent off-roaders who believe the best way to protect OHV recreation is to ban it.

4- A well-known “jeep-type” tour guide on the Rubicon Trail decides to switch vehicles and start using highly modified side x sides. This new venture starts a national debate on which vehicle -- side x side v. “jeep-type” -- is the better and more reliable trail rig. Blogs explode with opinion.

3- Several large green foundations withdraw support from the Center for Biological Diversity because their lawsuits seeking to ban OHV recreation on public land or “minimize” FS road networks have not been cost effective. To keep donors, CBD joins forces with several mainstream conservation groups to support OHV recreation on designated roads, trails, and areas.

2- Rocker motorcycle enthusiasts, Twisted Sister and Tommy Lee, host fundraiser in LA for OHV advocacy groups. The event raises about $2,000,000 dollars to help keep trails open.

1- Mitt Romney wins the GOP nomination for president and selects Jon Huntsman (a dirt-biker and SX fan) as his VP. Both attend several off-road events and speak to the crowds.

Political Turmoil at CA State Parks - Rangers Ask Gov. to Replace Coleman

Sometimes the irony of an issue requires a comment. Just as thousands of OHV enthusiasts, local and national recreation organizations, government park rangers, and elected officials ask Governor Brown to reappoint Daphne Greene as Deputy Director of the CA OHV Program, a large group of state park law enforcement officials are asking that Ruth Coleman (Director of CA State Parks) be replaced.

I know Coleman and have worked with her department on many issues and I too like her on a personal level. However, I believe Coleman’s greatest weakness was her inability to make the non-motorized units of State Parks relevant to Californians in this day and age of decreased budgets and low visitor usage.

Rather then make the non-motorized state park system relevant (which should have included converting several of them to SVRAs), it appeared that Coleman, some non-profit foundations, and the legislature relied on the OHV Trust Fund (and a bogus statewide fee initiative that was rejected by voters) as an easy crutch to prop up a broken department.

Just what the Governor does with the Coleman and Greene appointments will be a signal as to the longevity and/or viability of either program. Will Coleman get support letters coming in from politicians and user groups, as is the case with Greene? (see below examples)

HQ does not want to waste your time with an extensive recap of the past week’s news that Daphne Greene (Dep. Director for the CA OHV Program) was given a termination notice by the Governor’s Office. December 31, 2011 is currently her last day on the job.

While state and national OHV groups reviewed this issue last week (a smart thing to do in politics), there arose a massive grassroots movement led by YOU – the OHV enthusiast.

OHVers starting sending in letters to the Governor's Office and made phone calls as well. Local legislators were also contacted. As noted in the SacBee article below, OHV Commission Chairman, Eric Lueder, sent in a strong letter of support for Greene’s reappointment.

After spending several days digging thru the political swamp that exists in Sacramento, HQ believes Greene’s termination was prompted by a nasty smear campaign (yes, politics is a nasty business) led by a few extreme anti-OHV non-government and government activists.

HQ believes that unlike most political appointments, the Governor does not have an immediate replacement already selected. In fact, his office may be open to Greene’s reappointment if the OHV community makes a strong case on her behalf.

CA Governor Makes Political Decision to Replace Current OHMVR Deputy Director

HQ has a motto that “All land-use (and staffing selections) decisions are political decisions.” Well, that axiom came to life yesterday via the announcement by Daphne Greene, deputy director for the California OHV Program at State Parks, that she is being replaced on December 31 by another Governor’s appointee. That news sent a violent shockwave through the OHV community.

During her tenure of almost 8 years, the OHV Division went through a number of much needed reforms that improved all aspects of the program. Some of those milestones include; streamlining the grants program, improving the wildlife habitat monitoring, fiscal accountability for the OHV Trust Fund, creating new soil standards and guidelines, opening new OHV areas, funding important trail restoration projects, and the list goes on and on.

As OHV leadership continues to assess this new political development, I believe that we will learn a lot by the person who is appointed to take over Daphne’s post. HQ hopes the Governor will appoint somebody that will continue Daphne’s legacy of accountability, environmental stewardship, and commitment to the program and the community it serves.

Stay tuned for future developments on this issue and during this Christmas and Holiday Season let’s give thanks for Daphne’s (and her staff) unwavering commitment and service to you and your family’s favorite form of outdoor recreation over the last 8 years.

OHVers in the SF Bay Area got their dose of a closure oriented “sportsmen’s” group several years ago when the California Sportfishing Protection Alliance filed a suit to “protect fishing” at the Carnegie OHV Park. Trouble was that there have never been any fish in the tiny intermittent stream that runs in the center of the park. It was totally a faux issue much like the effort being used to unseat Congressman Rehberg.

HQ Thoughts on Thanksgiving 2011

HQ wants to share some thoughts with riders today on the eve of Thanksgiving 2011.

As some of you know, I tore (completely detached at the kneecap) my quad muscle in late March this year when I slipped in the mud while doing some yard work at my mom’s house.

Some of you have heard the gory details of that experience, but I will spare this audience from that recap (pardon the pun).

Being almost completely helpless for about 6 weeks and unable to walk taught me several important lessons in patience, humility, and courage. It also helped deepen my appreciation for our military and wounded warriors who come home with devastating injuries.

During my recovery, the thought of being able to ride off-road again seemed like a distant and remote possibility.

I am thankful for my family and friends who helped support and encourage me over the last 7 months. In the great scheme of my life, this injury may only be remembered as a small bump in the road. However, I hope the life lessons learned over the last few months will help make me a better person and leader.

Being out on the trail once again has been uplifting and fun. But it is the character building that I treasure most. Thanks again for all your support and friendship.

Famous Eco-Law Group Closes its Doors

By now, many HQ riders know about the recent departure of Carl Pope from the Sierra Club and the 31 % cut in staff made by The Wilderness Society over the last year.

HQ believes much of that is based on a downturn in the economy that has hit basically all non-profit land advocacy groups. Also, with most if not all “Wilderness quality” lands being already designated by Congress as federally designated Wilderness, pro-Wilderness groups may have become less relevant in 2011.

HQ was also surprised to learn today that a rather famous environmental law-firm had recently closed its doors. Wildlaw, who had hired a former Bush-era cabinet member as their lobbyist in Washington DC, specialized in anti-OHV and anti-timber lawsuits.

As you know, unelected CARB regulators create their own arbitrary rules (often behind closed doors) when it comes to automotive, truck, and motorcycle emissions. I have been at CARB hearings where their staff appears more interested in promoting their own political agenda instead of listening to good science brought forth by the public and industry.

After watching BRC’s Greg Mumm and other panelists testify at the House Subcommittee on National Parks, Forests, and Public Lands hearing yesterday, I got a sick feeling that I just witnessed the agency’s ill-advised commitment to yet another planning boondoggle similar to the 2005 Travel Management Rule.

To address my nausea, I went online to order some Pepto-Bismol but I got a note back that all lines were busy since it appears that most of the environmental law firms in the U.S. were ordering truffles from France, blowfish from the Pacific, walrus blubber from the Far North, and beluga caviar from Russia in celebration of the agency opening up the door for a guaranteed avalanche of new eco-lawsuits. Those suits will be based on the Forest Service’s inability to maintain species viability that will now extend to fungus, microscopic organisms, and bacteria.

HQ has seen what has happened to OHV recreation when the agency did not adequate protect (according to environmental attorneys and courts) the Spotted Owl, the Goshawk, certain frogs, etc. Now the environmental conflict industry will be filing suits seeking court decisions that will close public lands to multiple-use recreation because human activities may harm bacteria and fungus.

If the agency does not substantively change the final planning rule to address the concerns stated by BRC and other panelists yesterday, the Great Off-Road Prognosticator “Donstradamus” foresees that an incalculable number of eco-lawsuits will be filed based on the vague species viability protection requirements in the planning rule.

The House Natural Resources Committee tomorrow will explore a sweeping Forest Service rule that would serve as the template for managing the nation's 193 million acres of forests and grasslands.

The Subcommittee on National Parks, Forests and Public Lands oversight hearing will feature testimony from Forest Service Chief Tom Tidwell and will also probe the agency's management of off-highway vehicle access and its issuance of special-use permits.

The agency's draft planning rule, first announced in February, will determine how the agency's 175 national forests and grasslands develop individual management plans, which govern activities from logging to recreation and the protection of endangered plants and animals (E&ENews PM, Feb. 10).

The rule aims to speed planning efforts, incorporate best available science, engage the public and ensure forests' resilience to climate change, pests and other threats, the agency has said.

But it has drawn its share of critics, including Republicans on the House Agriculture Committee, who warned it could open the door to special-interest lawsuits and would fail to ensure timber harvests will increase across the nation's millions of acres of national forests (Greenwire, May 5). Environmental groups have criticized the proposal for giving too much discretion to local forest supervisors and lacking rigid standards for protecting water and wildlife (E&ENews PM, May 16).

The agency has said it intends to finalize the rule by the end of the year.

Tomorrow's discussion will likely also address the agency's implementation of a 2005 travel management planning rule, which Tidwell has said helps ensure motor vehicle users have guaranteed places to ride in the forests.

While supporters credit the rule for preventing motor vehicles from muddying streams, harming fish and spreading weeds, many Republicans and off-highway vehicle users say it has led to the unwarranted closure of trails.

"Congressional oversight is needed regarding the agency's closure of tens of thousands of roads and trails over the last decade," said Greg Mumm, executive director of the Idaho-based BlueRibbon Coalition, a trail access coalition.

Mumm, who was invited to testify at the hearing, said OHV users initially supported the process but that in some cases it has been used to make landscape-level changes to forest plans and close large numbers of existing legal trails and authorized routes.

Some forest supervisors say travel management planning decisions are the most difficult they make.

The issue came to the fore earlier this year when Rep. Wally Herger (R-Calif.) successfully passed an amendment to a House spending bill that would have restricted the agency's implementation of the rule. Rep. Mike Simpson (R-Idaho), who voted for the amendment at the time, later panned the move as unnecessary (E&ENews PM, March 11).

Mumm said his group has also recently asked lawmakers to pass a bill that would streamline the agency's issuance of special-use permits, a process he called overly complex and expensive.

Tomorrow's meeting comes less than two months after the committee held a field hearing in California to hear from the Forest Service, state officials and citizens about land-use regulations, policies and actions affecting access to agency lands.

In HQ’s opinion, “Round One” of TMR has been a huge failure and public relations nightmare on many units. TMR was supposed to be a positive planning effort to address the proliferation of illegal routes and “unmanaged” OHV use on federal timberlands.

However, instead of focusing their energy to manage OHV recreation, TMR focused on landscape level closures (on many Forests) of thousands of miles of historic and popular roads and trails used by the OHV community and general public.

HQ has believed the key to resolving this rather contentious paradigm was for the agency to move into post subpart B project level trail planning and reestablish a good working relationship with local government and users.

The Shasta Trinity National Forest may be a good case study on finding a way forward based on the news article from the Redding Record Searchlight.

Update on CA State Water Board and OHV

As some of you know, the California State Water Resources Board has been reviewing water quality issues for the last 2 years. This is an important topic for OHV interests because our sport could be dramatically impacted by new regulations and/or restrictions developed by the board. HQ is proud of the work that John Stewart (CAL4WD Rep. and BRC Board Member) has done on this project. A December 6, 2011 meeting at CALEPA in Sacramento has been scheduled for consideration of adoption of: 1) a proposed statewide Waiver of Waste Discharge Requirements for Nonpoint Source Discharges Related to Certain Activities on National Forest System Lands in California, and 2) a supporting Mitigated Negative Declaration

Public comment on proposed changes to the State Waiver will be accepted until November 21. 2011.

After reviewing the changes to the proposed State Waiver, I believe all concerns submitted on behalf of CA4WDC have been adequately addressed. Specifically, the revision clearly articulates that NEPA review applies to all projects and activities initiated under the proposed State Waiver. In addition, clarification of State Categories A and B have been clarified with their relation to USFS “projects and activities”.

With the release of this revision of the proposed State Waiver, the SWRB has clearly noted that a CEQA Environmental Impact Report of the proposed State Waiver as supported by the environmental community and others is not warranted.

The "effect" of this action is that all National Forests in California will now have consistent guidelines dealing with water quality without having to submit each activity or project to the appropriate Regional Water Quality Control Board for approval.

The proposed State Waiver accepts the USFS Water Quality Management Handbook as the guide for the management activities such as road maintenance, grazing, mining, and all activities requiring a permit.

As long as projects comply with the guidance in the Handbook, they should proceed with no extra approval or review necessary. The Handbook, in existence since 2001, has been updated and defines actions to be used by Forest Service, contractors and permittees involved in activities or projects on National Forest lands within California.

Over a period of almost two years, stakeholders have held meetings discussing the Handbook content and the proposed State Waiver. All documents have been circulated for public review and comment. Extensive legal review has been conducted by State Water Board and USFS to ensure compliance with state and federal laws. I have been an active participant in all phases of the discussions and meetings on this topic as the statewide OHV representative selected by USFS staff.

HQ’s missive today is not an endorsement of the court’s decision that negatively restricts the agency’s ability to do resource management of federal timber in inventoried roadless areas.

Our view from a strictly trail-based recreation perspective is that the court decision validates the appropriateness of OHV recreation in IRAs. Unlike the early days of the roadless battle where you had some Forests closing jeep routes in IRAs because they interpreted the Clinton Roadless Rule as a closure directive, you now have green groups, FS, and the court supporting the designation of OHV routes in IRAs.

HQ TMR UPDATE - Mistakes in Tahoe National Forest MVUM

The Recreation HQ wants to thank members of Pirate4x4.com for alerting us to the fact that there are a number of mistakes in the newly published Tahoe National Forest Motor Vehicle Use Map.

Some of the route designations (and/or vehicle type classifications) that appear to be in error includes the Rubicon Trail, Trail 16E10, Rattlesnake Trail 10E02, 11E18, 12E67,
11E67, 11E21, and routes/areas associated with Boca, Stampede and Prosser Reservoirs.

HQ has been in communication with the Tahoe National Forest and the Regional Office
and has been assured their leadership and staff are now acutely aware of the mistakes and are working to correct them. HQ has encouraged Pirate4x4.com members to send in the mistakes you have found to the Forest Service.

While mistakes in new MVUMs can be a common occurrence, it has been our experience that the agency works hard to correct those errors. However, HQ has seen where LEOs have written tickets based on inaccurate information contained in new MVUMs. HQ has shared its concerns with the FS and is urging them to communicate potential errors with law enforcement staff so that we do not have young kids, their parents, or tour guides given tickets when operating their OHVs in a legal manner.

STONYFORD UPDATE - County Closes Correctional Facility, Land Exchange in Limbo

For the last several years, HQ has updated riders on the potential for the Fouts Springs Youth Correctional Facility to be deeded over to Solano County. Recently, Solano County closed the facility due to it being fiscally unsustainable.

As you know, BRC had been opposing the land exchange because of concerns it had that the county would sell the property (they had operated the camp under a FS special use permit) to the highest bidder with said use being a conflicting use (i.e. Robert Redford’s Environmental Activist Training Center or new Sierra Club Conference Center, etc.). Those conflicting uses over time would require the FS to close the area to OHV recreation.

HQ does not celebrate the loss of those rural jobs when the facility closed. However, it believes that if the Forest Service turns that facility into a remote fire-training center… that many of those who lost jobs could be employed at the new camp.

The facility could also be used as a training center for trail crews such as the Student Conservation Association.

HQ was amazed to read EPA’s September 29, 2011 bizarre response to the OHMVR Commission’s June 21, 2011 letter to Congress which challenged the agency’s stance that Clear Creek should be closed to OHV recreation.

Instead of functionally acknowledging the recent IERF study that shows OHV recreationists at Clear Creek only face a slight health risk (much lower than other activities), EPA stubbornly and with a certain amount of bravado insists that its original study and closure-oriented conclusions are correct.

HQ on Buying a Dual Sport Motorcycle in 2011

Over the last year or so, HQ has gotten a lot of phone calls and emails from riders who are seeking advice on buying a dual-sport motorcycle. It appears most of these questions are being prompted by recent FS Travel Management-related closures of level-3 roads to non-street legal OHVs.

For those riders who are looking for a street-legal off-road motorcycle, HQ suggests they purchase a new street-legal dirt bike or a used bike that was plated and/or grandfathered in before the State of California closed the dual-sport conversion process (circa late 2003/early 2004).

HQ believes that manufacturers have stepped up to the “plate” and are producing true off-road worthy dirt bikes and when given a choice… riders should select a bike that complies with the licensing requirements that govern our sport.

When it comes to upgrading your RV’s 12-volt charging system, the Recreation HQ wants to suggest you may want to consider the Ganz 6-watt marine-grade solar panel to keep a charge on your batteries.

Recently, HQ had to install new batteries and a new power converter on its official 26ft. Weekend Warrior Land-Use Battle Trailer. One of the issues that RVers face is how do we keep a charge on our trailer batteries during the day when we are out on the trail? Or, how do we keep a charge on our batteries when parked at the HQ or house?

HQ is proud to report that it appears to have found an answer to that age-old question.

After doing some research online, we ordered a Ganz 6-watt marine-grade solar panel and marine-grade charge controller from Amazon.com for about $100 bucks.

So far the solar panel - not only maintains a charge on the batteries - but also puts an additional charge into the batteries during the day while HQ is out in the field.

HQ believes that common sense solar applications like this can be a solution for RVers who want to keep their trailer “charged-up” when they are on the trail or the unit is parked at home.

Gov. Signs AB42 - Link to More SVRAs in CA?

HQ was pleased to see the Governor sign AB 42, which allows for non-profit organizations to manage various state parks that have low visitation or are otherwise unable to sustain themselves. HQ believes that counties should also be given the opportunity to manage state park units that are in fiscal trouble.

HQ believes this bill could open the pathway for OHVs to use several non-motorized state parks units that are in fiscal trouble. Two examples come to mind. Henry W Coe State Park near San Jose is a perfect candidate for being operated as a State Vehicular Recreation Area. Also, Tolowa Dunes State Park near the Oregon border is also a great candidate for OHV use because its last management plan authorized ATVs at the site.

The OHV community should be looking for ways to assist state parks and the local economy by finding a way to help manage these parks for motorized recreation. Henry Coe SVRA would help elevate overcrowding at both Hollister Hills and Carnegie SVRAs. Tolowa Dunes SVRA would provide much needed ocean/sand opportunities for OHV use on the North Coast.

BREAKING NEWS - County Votes to Petition Congress to Designate Clear Creek as NRA

The Recreation HQ is proud to announce the San Benito County Board of Supervisors voted today 5-0 in favor of a Resolution to petition Congress to designate the Clear Creek Management Area as a National Recreation Area.

HQ’s Don Amador gave a presentation regarding the need for Congress to step in and bypass the local land manager when he/she is not acting in the best interest of the public. Besides Amador, a number of OHV recreationists and a local newspaper owner stepped up to the podium and supported the County’s effort to champion access on behalf of their constituents.

Chairman Margie Barrios also cited the many campgrounds the Hollister Field Office had ripped out over the last several years and the recently constructed multi-million dollar taxpayer-funded “decontamination center” as prime examples of government waste.

HQ believes access champions have taken one giant step in this long journey. Certainly the trail will be rough over the next few years while efforts are made to have Clear Creek designated as a National Recreation Area. However, it is a journey that all of us should be prepared to take.

The Recreation HQ could not let this week end without making a comment on some of the crowd’s “verbal ugliness” directed at the environmental representative (and to some extent at the Forest Service official) at the September 19, 2011 House Subcommittee on National Parks, Forests, and Public Land’s hearing held in Sacramento.

Nobody supports vigorous and spirited debate on public land access issues then I. However, at the hearing some in the audience crossed the line between civil public discourse and inappropriate name calling and heckling.

Over the years, I have sometimes been the only conservative land-use representative at meetings largely dominated by far left-wing eco-zealots. But at those meeting (and to my surprise), I was not rudely hit with over-the-top insults and slurs.

HQ understands the anger in the OHV community about how thousands of miles of historic access routes have been closed over the years by eco-lawsuits and government overregulation. In fact, these closures make my blood boil too.

However, OHV’s cause is not advanced in the public arena when it resorts to ugly and hostile rhetoric.

ABC NEWS STORY on CLEAR CREEK - EPA/HFO Makes Case for NRA Designation

Many riders watched the ABC feature story last night regarding the ongoing closure of the Clear Creek Management Area to all users. A big HQ salute is given to local off-road advocate Ken Deeg for telling his story to the reporter. As far as mainstream media coverage goes for OHV recreation, HQ believes the story scored an 8 out of 10.

What struck HQ the most out of the whole video were statements made by EPA and Hollister Field Office officials. Just as Don Amador stated in his June 22,2011 testimony before a Congressional Subcommittee hearing in DC, EPA/HFO continue to give their agencies a black eye by showing their collective intent to permanently close or severely restrict OHV recreation at Clear Creek.

While CA state parks spokesman, Phil Jenkins, did a great job sharing the OHV Division’s perspective on the issue and risks associated with high risk sports such as OHV, swimming at public beaches, rivers, and lakes, rock climbing, and snow skiing, HQ believes that ABC should have also interviewed one of the scientists from IERF.

As you know, on March 22, 2011 a report was completed by scientists from the International Environmental Research Foundation (IERF), the Department of Physics at Harvard University, and the Center for Applied Studies of the Environment at the City University of New York.

According to that new and scientifically valid report, “…the [health]risk at Clear Creek is similar to the lifetime risk of death from smoking less than one cigarette over a one year period. They noted other recreational activities, such as swimming, hiking, and snow skiing are over a 100-fold more dangerous.

In summary, EPA/HFO’s statements in the ABC story only validated and strengthened Amador’s June 22 recommendation to Congress that they should consider bipartisan legislation that designates the 70,000-acre CCMA as a National Recreation Area with OHV recreation and other multiple-use recreational activities codified as “prescribed uses.” Congress could designate as “open” all 242 miles of routes and 400 acres of open areas identified for motorized use in the 2005 CCMA Travel Management Plan.

HQ believes HFO/EPA have lost their objectivity and credibility during the CCMA debate by inserting junk science and their personal political agendas into the decision-making process. Every day that CCMA remains closed to public use means that Congress is one day closer to deciding the future of Clear Creek by designating it as a National Recreation Area.

The Recreation HQ does not know if it is mere coincidence that Region 5 appears to be revaluating current directives to various Forest units to not designate level-3 roads for mixed-use and to minimize the designation of historic and important unauthorized routes, but it appears that a change is in the air.

The potential signal that R5 is listening to local users, county officials, and Congress is best illustrated by the September 20 Federal Register Notice regarding the Modoc National Forest’s proposal to designate 331 miles of unauthorized routes for motorized travel and designate 513 miles of level 3 roads for mixed-use (i.e. use by non-street legal OHVs).

Some of you may remember that back on March 11, 2010, R5 upheld an appeal by one of the current anti-access OHV commissioners and nationally recognized closure guru, Stan Van Velsor, and ordered the Modoc to not designate 331 miles of routes and 513 miles of level-3 roads for mixed-use.

Another sign based on intel from local users groups who attended a Board of Supervisors meeting yesterday in the Redding area is that the Shasta-Trinity NF is also reviewing future post subpart-B project level trail planning and designation of some level-3 roads for mixed-use.

If, in fact, the Forest Service is reviewing future trail and mixed-use designations, a great deal of praise should go out to an engaged public and to the federal officials and land-managers who are moving forward on more access friendly TMR-related projects.

Trail history was made yesterday in California when a congressional subcommittee held a field hearing that was primarily focused on the loss of multiple-use access to, and use of, our national forests.

As HQ told attendees at the Ride Reno 200 Dual Sport banquet on September 17, the OHV community has a lot to be proud of as they are now having their access issues being addressed by both the House of Representatives and the U.S. Senate. Two examples of that seismic shift was that a representative from U.S. Senator Dean Heller’s office was at the banquet to listen to concerns about special recreation permits being denied to clubs and there was a September 19 field hearing in Sacramento. At the field hearing the loss of forest trail access, abuse of the event permitting process, and forest health were front and center.

HQ is very proud of all the access and multiple-use witnesses including Charles Hirst, president of the California Enduro Riders Assn., and Nick Haris, the western representative for the AMA. PEER’s testimony that OHV recreation brings zero economic benefit to local communities was shot down quickly by Eldorado County Supervisor, Jack Sweeney. Plumas County Sheriff Hagwood gave very compelling testimony. The hearing played to a packed house.

For several years, HQ has blogged about how the 2005 Travel Management Rule was being misused on number Forests as a planning tool to effect landscape level closures of historic roads and trails to non-street legal (and in many cases street legal) OHVs.

HQ is not the only venue that feels TMR has gone astray. The Chico Enterprise-Record just published an editorial that concurs with our observation.

Wisdom tells us that you should not build a house on a foundation of sand. HQ believes many of the fatal flaws now clearly evident in TMR have their origin in the 2003 California Route Inventory and Designation Process (RID). Proponents of RID (as in get rid of OHVs on public lands) said users did not have to worry about landscape level closures of historic (and legal) OHV routes. In addition, RID/TMR in Region 5 also included the additional “thumb in the eye” of creating a new federal directive that effectively prohibited (except on rare road segments less then 3 miles in length) non-street legal “Green-sticker” OHVs from using level 3 non-paved logging roads. What makes the R5 ruling even more offensive is the California Vehicle Code expressly states that Green-sticker OHVs are allowed on non-paved logging roads.

Back in 2003 when RID was codified, several FS staffers told HQ offline that supporters of RID would rue the day. BRC strongly protested RID because it was basically an underground regulation created without a formal public process as required by NEPA. Based on the expected tone and direction of the September 19 field hearing it looks like those RID/TMR “planning chickens are coming home to roost.”

Can TMR be salvaged in CA and elsewhere? HQ believes it can, but the agency must work hard to address the user’s legitimate concerns and restore public trust. The FS should also start their long heralded post Subpart B project level trail planning.

Sand should never be used as a foundation nor should it be used as a place where you stick your head. Instead, good planning and management should be based on solid rock and you (the FS) should man-up and admit that mistakes were made in RID/TMR.

Some may remember when President Clinton during his last days in office created a number of new monuments throughout the West including the Sequoia National Monument in California.

On behalf of the BlueRibbon Coalition, I want to thank the Save the Riders Dunes’ leadership for hosting the 2011 CORDRAM Tour. The tour was a real educational experience for the Recreation HQ.

In a 3-day period, the tour covered much of the three main OHV riding areas in the Oregon Dunes National Recreation Area (ODNRA). On Sunday, Jerry Ingersoll, the Forest Supervisor for the Siuslaw National Forest, took personal time off and joined the group – in some “BBQ Diplomacy” (actually it was peanut butter and jelly sandwiches) - to discuss various recreation and resource issues.

Rodney Roberts, a Coos County Deputy Sheriff, also joined the group to share his views on law enforcement on the dunes. Rodney also mans the Sheriff’s substation at the Riley Ranch ATV Park. The tour got to observe the Dunes Patrol (a volunteer group) in action when they rescued a stranded 4wd enthusiast that got stuck.

It was an eye opener to see the scores of OHV dealerships and OHV-related businesses along the 40 miles of Highway 101 that runs the length of ODNRA. It was clear the local economy is strongly tied to OHV recreation.

HQ believes the Forest Service offers the public one of the premier destination OHV recreation sites in the country. It has well-developed camping and staging areas. Also, there are many private OHV camping areas that provide more developed facilities (pull-throughs, lodges, group camps, etc.) often popular with today’s recreational community.

The owner of the Oregon Dunes KOA campground gave the group a guided tour of his facility. He said that most of his customers come from WA, CA, and OR. However, there are riders that come from all 50 states and from overseas. Also, OHV recreation is a popular activity enjoyed by military families when the service member is on leave.

There is a lot of hard work ahead for both the agency and user communities. However, after meeting federal, county, and local recreation leaders, I am optimistic that the future of the dunes can be secured if those interests find ways to increase communications and cooperation.

The Forest Service has extended the public comment period until September 1, 2011. I am deeply concerned that anti-access groups and their supporters in Congress will try and have Section 446 stripped when the House considers H.R. 2584, the Department of the Interior, Environment and Related Agencies Appropriations Act.

Section 446 is Congressman Wally Herger's pro-access language that attempts to fix some anti-access tenets from Region 5's version of the Travel Management Rule. Section 446 is almost identical to bill language in Herger's H.R. 242 that was introduced in February 2011.

The main issue is the Forest Service has proposed to close hundreds if not thousands of miles of old logging roads to non-street legal OHV use. This access is important for continued recreational access, connectivity between existing OHV trail systems, and the rural economy.

In addition, SRR has buried deep within its website a red herring. That deal killer is the “big license plate” mandate for OHVs that groups such as PEER have been pushing hard for since 2003.

The most damage caused by SRR to legitimate national and local OHV groups is they confuse the largely disengaged motorized recreation community by trying to get them to join and therefore legitimize their group. Users that might join a legitimate OHV group have now just joined (for free) an OHV group that often promotes the closure of historic and important OHV trails.

If HQ could give advice to TU and other green groups it would be to drop the old and tired “hey, lets start a new faux OHV group” from their playbook and instead try and work with legitimate OHV groups to promote a responsible land use agenda that appreciates and supports a holistic approach to management of motorized recreation on public lands.

BRC Issues National Call for Legislative Fix to Permit/Cost Recovery Mess

For several years, OHV clubs such as the California Enduro Riders Association has been going through an ugly type of “permit hell” regarding several of its long-standing events held on the Eldorado National Forest.

Also, Amador (and several local OHV leaders) has requested that the Forest Service extend the comment but has not heard back from the agency at the time of this posting. BRC has also sent letters to Coos, Douglas, and Lane County Commissioners asking them to review this issue.

OR Dune Riders Must Stand Up and Fight Back Against More Closures

By now, many of you already know about the ongoing closures to OHV recreation at the Oregon Dunes National Recreation Area (ODNRA). HQ has heard an interesting theme that has been coming from users, resource professionals, and other interested parties. That narrative states that if the Forest Service does not aggressively attack the rapidly encroaching vegetation… there will not be a dune riding area at the NRA in 20 years.

Algore Roadless Chief Behind Closure Agenda at Oregon Dunes?

Being all to aware of the historic loss of motorized access to ocean beaches in California, HQ has been particularly troubled by a similar loss of beach and dune access at the Oregon Dunes National Recreation Area (NRA).

For the last two years BRC member, Jody Phillips, has been part of a dune working group (there were other OHVers there too). As part of that group, he has championed well-managed and continued motorized dune-based recreation on the unit.

Unfortunately, it appears the NRA is going to continue down the path of more closures (and poor management) if OHV users don’t stand up and fight back.

In June 2011, the Forest Service issued a Notice of Intent that started a public comment period for a proposed action related to OHV recreation. The comment period ends July 25, 2011.

Jody and a number of other OHV recreationists have contacted HQ and the BRC about reviewing the proposal and helping craft comments and take other actions to protect OHV recreation at the Dunes.

Although HQ and BRC are still in the process of reviewing the documents, HQ took some time to review the ongoing and tragic loss of motorized access to the NRA. Here is what I have found.

In 1972, about 28K acres of the 32K acre ODNRA was open for OHV/motorized use. In 1979, that was reduced to 15K acres. In 1994, that was reduced to less than 6K acres for open riding. Even though the FS states there are an additional 4,500 acres open for motorized use on designated trails, the actual land footprint for the few miles of trails is less than a couple of acres.

The staggering loss of access, which was most notably realized in the 1994 Dunes Management Plan, caused HQ to see what Forest Service Supervisor presided over, crafted, and authorized that loss. It was not really surprising for HQ to find that it was, Jim Furnish, one of Algore’s chief architects behind the now infamous (circa 1997-2001) Clinton/Dombeck/Algore Roadless Plan. Today, Furnish is a board member of one of the most anti motorized trail/road groups in the country.

New Interior Economic Report Scrubs OHV Recreation

Last week, I testified before the House Subcommittee on National Parks, Forests, and Public lands about the Hollister Field Office obliterating all evidence that OHV recreation had existed at the Clear Creek Management Area. And, the unit had even scrubbed all OHV symbols from their main website.

In 2005, the Forest Service published a recreation report that stated approximately 23% of Americans participate in some form of OHV recreation each year.

Just as Obama’s Great American Outdoor program failed to reference or acknowledge that OHV recreation even existed, Interior’s newly published Economic Report failed to reference OHV recreation. The Report failed to acknowledge that OHV recreation is an important element of the recreation opportunity spectrum and is also an important economic multiplier.

In HQ’s opinion, this Interior report has little if any credibility. By ignoring the huge off-road aftermarket (custom shops, parts, wheels, tires, etc.) and industry (4WDs, dirt-bikes, ATVs, RVs, trailers, and UTVs) and service industry (hotels, food, restaurants, fuel, etc) – the report ends up being nothing but a propaganda tool used to champion the agency’s non-motorized political agenda.

HQ supports both non-motorized and motorized recreation. Hiking, fishing, biking, and other uses are important. But what Interior has done is try the old divide and conquer techniques that at the end of the day are ineffective. Again, this report only serves to daylight the administration’s non-motorized political agenda.

CA OHV Commission Sends Letter to Congress on Clear Creek

As many of you know, the OHV commission held a hearing on April 5, 2011 in Hollister to discuss many issues - but the focus of the meeting was to daylight the new OHMVR Asbestos Study that was released on March 22, 2011.

After a lot of public testimony, the OHV commission voted to send a letter to Congress expressing their views on Clear Creek.

HQ agrees with the tone and direction of this OHV Commission letter where in its summary it states the continued and proposed permanent closure of CCMA does not appear to be supportable nor in the best interest of the public.

HQ believes this OHV commission letter only strengthens the points made during Amador’s testimony/exhibits about the HFO/EPA’s flawed decision-making process and how that process - based on junk science and personal agendas – was designed to create a defacto-Wilderness area at Clear Creek.

HQ believes that this hearing was extremely important for the recreating public, Congress, and the agencies. Many of you know that my testimony was focused on Clear Creek and the efforts by the Hollister Field Office and EPA to continue to use junk science and personal agendas to create a defacto-Wilderness area and erase all evidence of OHV recreation that once existed on the unit.

HQ believes it was important that Congressman John Garamendi attended the hearing to represent the minority. As a former Deputy Secretary at the Department of Interior he is very aware of the Clear Creek issue. As you watch the Q and A you will hear him state that he supported the original emergency closure but was confident that the new science (IERF Report) and pressure from access interests would result in a formal hearing on Clear Creek.

HQ believes that OHV recreation is coming of age and making history this year via efforts by pro-access legislators who are addressing trail specific issues such as TMR, permitted events, level 3 roads, and Clear Creek. Chairman Bishop and his committee members should be commended for their hard work on behalf of the recreating public.

HQ also wants to thank all those who have worked hard in the fight to reopen CCMA. Also, the OHV commission should be commended for having the foresight to ask OHMVRD to commission a study regarding potential health risks from NOA. HQ believes that determined riders combined with new science and interest from Congress will greatly increase the chance of CCMA being reopened (or designated open by Congress) for OHV recreation.

PUBLIC LANDS: Lawmakers to explore recreational opportunities, controversies

The House National Parks, Forests and Public Lands Subcommittee on Wednesday will explore opportunities and controversies surrounding outdoor recreation on public lands, which include hundreds of millions of acres managed by the Bureau of Land Management, National Park Service and Forest Service.

The hearing will consider recreational access to public lands and the economic benefits of activities such as hiking, fishing, hunting and off-highway vehicles including snowmobiles.

Visits to recreation sites on BLM-managed lands and waters have increased significantly in recent years, numbering well over 50 million in 2008, the agency said. But despite the increased popularity, controversies over management of the recreational opportunities persist.

Don Amador, Western representative for the Idaho-based BlueRibbon Coalition, which advocates for motorized trail access, said he is concerned a 2008 BLM decision to close access to the Clear Creek management area in California is based on flawed science.

"I'd like to question the decisionmaking behind that closure, I'd like to challenge the science that was used," said Amador, who was invited to testify but was not yet confirmed as a witness by publication time. "It's my hope that Congress will take a look at this."

He said he is also concerned with the Forest Service's 2005 travel management rule and argued it has been used to justify landscape-level closures to motorized recreation, particularly for dirt roads that have been in use for decades.

"Literally thousands of miles of those roads have been closed due to misapplication of the 2005 rule," he said.

The Forest Service manages approximately 280,000 miles of forested roads open to motor vehicle use, Joel Holtrop, deputy chief of the National Forest System, told a Senate panel in 2008. A third of the roads that are managed by the agency, or 47,000 miles, are open to motor vehicle use including over-snow vehicles and motorized watercraft operating on water trails, he said.

Conservation groups have warned that an unregulated rise in off-highway vehicles on public lands can imperil wildlife, destroy sensitive vegetation and cause erosion.

"The first motor vehicle driving across a particular meadow may not harm the land, but by the time 50 motor vehicles have crossed the same path a user-created trail will likely be left behind that causes lasting environmental impacts on soil, water quality and wildlife habitat," Holtrop told the Senate panel.

National forests and grasslands annually receive 192 million visits each year by motorized vehicle users as well as those who camp, hunt, fish, horseback ride, bike and ski, among other things.

About 11.5 million visits on national forests involve motorized vehicle activities, the agency said.

Paul Hart who is currently serving as the trails manager for the Cocinino National Forest will be taking over as the Trails lead on the Shasta Trinity National Forest on July 8, 2012.

According to D36’s Dave Pickett, over the 40 year history of the program over $200 million dollars has been stolen from the OHV program. I remember back in the early 70s when the OHV program was invented. Back then, environmentalists and the legislature told riders that if you let us take your state off-road fuel tax refund… we could have our own user-pay/user-benefit self-funded program

Well after recently doubling the green sticker fee it now looks like enviros and some legislators want to break that promise and continue stealing money from our Trust Fund.

Because of an unquenched thirst for funds from one of the only self-funded state programs, the enviros and some in the legislature feel a sense of entitlement from a program where riders already feel double-taxed and betrayed by the long history of “loans.”

Rather than steal money from the OHV program, PEER and some legislators should look for ways to make regular state parks more relevant, cost-effective, and self-funded.

Regarding the $200 million dollars - HQ wants to cite a quote from a popular and funny TV ad…”It’s MY money and I want it back.”

HQ says quit taking our money and pay back what you have stolen. And, stay off the slippery slope of interagency money shifting.

Court Says NO to Enviro Subpart A Claims on Eldorado Legal Case

Some of you may remember that BRC and other recreation groups filed to intervene in the case in January 2010.

The recreation groups had concerns that environmentalists would use this case to get a court to link a dollar amount needed by the agency to maintain a “minimum” number of trail miles on the unit. Even though OHV groups did not like the 2008 Eldorado travel plan we wanted to end the endless planning process and move forward with good management programs.

HQ feels that environmental groups are filling an avalanche of Subpart A lawsuits throughout the West to force a number on the agency and/or to require the agency to undergo Subpart A planning to establish a “minimum” route network before doing the Subpart B trail planning.

By using an “oil change” analogy (page 36), HQ believes the court rejected that argument when it denied the plaintiffs (enviro groups) their Subpart A claims.

Street Legal OHVs Gain Access into AZ Wildlife Refuge

HQ wants to salute the efforts of the AMA and BRC for their work to gain access for street-legal motorcycles and ATVs into the Cabeza Prieta National Wildlife Refuge.

Historically, the refuge has banned the use of street legal motorcycles and ATVs on a number of its roads that are open for 4x4 use. Thanks to a collaborative effort by my good friends, Nick Haris, and, Brian Hawthorne, they persuaded the unit manager that the area’s management plan did allow for the use of street legal motorcycles and ATVs on several of its roads.

By now a lot of riders and wheelers know about the Marine Corps’ proposal to expand into the Johnson Valley OHV Area. In fact, a lot of you have already sent in comment letters and attended meetings.

After talking with a number of active and retired service members including Marines and a Vietnam-era Green Beret, I am now more firmly convinced then ever that the ill-conceived plan was not based on a strategic military “need” but rather it appears to be based on the personal agenda of several high-ranking military officials.

Not once in the original scoping document or in the DEIS did the Corps justify the “need” to boot the OHV community out of Johnson Valley.

I would encourage those of you to read the BRC comment letter and consider sending in a letter of your own before the May 26 deadline.

All DEIS Alternatives Would Restrict Access

As you have no doubt heard by now, the United States Marines are seeking to establish a large-scale training range facility at the Marine Corps Air Ground Combat Center at Twentynine Palms, California. To this end a Draft Environmental Impact Statement (DEIS) has been released. Comments will be accepted until Thursday, May 26th.

The DEIS analyzes 6 alternatives for potential impacts to land use, recreation, public health and safety, air quality, noise, biological resources, cultural resources, geological resources, water resources and other resources. The preferred alternative is alternative 6.

Unfortunately, any of the proposed alternatives, including the Marines’ preferred alternative, will ultimately result in the loss of OHV access and possibly a complete closure of the Johnson Valley OHV area.

As an off-highway vehicle enthusiast I write to urge you to support the “no action” alternative in the Draft Environmental Impact Statement - Land Acquisition and Airspace Establishment To Support Large-Scale Marine Air Ground Task Force Live Fire and Maneuver Training. I recognize that the Draft Environmental Impact Statement (DEIS) notes that no action “...is not a viable alternative since it does not meet the purpose and need…” However, none of the 6 proposed alternatives, including preferred alternative 6, adequately address all issues including providing for recreation, particularly motorized recreation.

Local riders, and many from adjoining regions, have been pushed off of public lands and out of many areas of the desert for decades. While I understand that the Marines have a vital mission, there simply must be a better way to provide for adequate training while not essentially eliminating responsible access to Johnson Valley for motorized recreationists.

I encourage you to withdraw the DEIS in favor of developing a new DEIS with a broadened range of alternatives that include options that allow for the continued responsible use of off-highway vehicles (OHVs), and that recognize the vital economic impact that motorized recreation has in the area.

Monuments FOIA Update - Did Green Lobby Influence Treasured Lands Program in 2009?

As many of you remember, HQ, BRC, Congress, and other access interests had concerns in 2010 about the now infamous leaked DOI documents regarding its “Treasured Landscapes Initiative” that proposed to designate National Monuments throughout the West.

Based on those concerns that the proposal had been cooked up behind the scenes in smoke-filled backrooms with environmental groups, Don Amador, on behalf of BRC, filed a FOIA in February 2010 to see if those concerns were valid. That initial FOIA saga was filled with FOIA denials and appeals.

Then in June of 2010, Amador filed another FOIA to again try and ferret out any back door deals. Finally on Friday, May 13, 2011 (almost one year later), the BLM complied in part with the FOIA request. Under provisions of the “Deliberative Process Privilege of Exemption 5 of FOIA,” DOI/BLM redacted portions of the 405 pages of released documents. But, DOI withheld 2,016 pages of documents from the FOIA.

HQ has done an initial review and found that most if not all of the info was NOT relevant to the FOIA request. Our search was for evidence of where the agency had collaborated with environmental groups in 2009 while failing to include other publics and Congress in those discussions. No documents were provided that showed such enviro collaboration. Remember it was the agency’s narrative at the time that assured the public the plan was not unfairly influenced by the green lobby.

However, one email (dated 11/9/09) did reference a letter outlining thoughts from The Wilderness Society related to Salazar’s Treasured Lands Initiative.

Cuts to CA OHV Program? -- May Revise Today

As HQ and OHVers brace for the release of the Governor’s May Revise today at 11 am, it will be important to watch for proposed tax increases and cuts to the CA OHV Program.

It will be interesting to see just how big the cuts will be to the OHV Program. My fear (which I hope is not realized, but is based on Feb. budget battle) is that we could see a proposed cut of at least 50% to the $64 million dollar a year program (SVRAs, admin. and grants). That would cut the grants program from about $27 million dollars/yr. to approx. $13 million dollars. A similar size cut to the admin/SVRA side would result in impacts to SVRAs and the agency’s ability to administer the grants program and OSV program.

Of interest are the “triggers” included in some of the past loans taken (stolen) from the OHV Trust Fund that basically states -- "if budget cuts seriously impact the OHV program the borrowed funds have to be returned immediately to the Trust Fund."

HQ does not know just how solid those triggers are since the legislature can invent new rules as they see fit by simply writing a new law that exempts them from past promises.

70 State Park Units to Close in 2012?

Today HQ reviewed the long-awaited list of 70 proposed state park units that are slated for closure in 2012 pending the outcome of the current budget battle. No SVRAs appear to be on the list. There are about 272 state park units, 8 of which are SVRAs.

HQ has urged state park leadership to make state parks relevant to the public as a way to bolster visitation and enhance revenues. HQ believes that some non-motorized park units (i.e. Henry Coe in the S. Bay Area, etc.) would make a great addition to the 8 existing SVRAs. Closure does not have to be the only option.

So far it does not look like any SVRAs are on that list as of today. OHV leadership (including The General) will have to keep a sharp eye on the state budget battle, as things are sure to get real ugly over the summer.

HQ believes that OHV recreationists are in a unique position politically given the current make-up of Congress combined with the President’s Great Outdoor Initiative to ask legislators to honor OHV recreation with its own day.

According to a 2005 Forest Service Report on OHV Recreation, 23.8 percent of the American population (age 16 or older) participated one or more times in OHV recreation during the last year (of the report).

Congressional Fix Needed to Address OHV Permitted Event Boondoggle

The ongoing assault on permitted OHV events is a complex issue. First, you have “cost recovery” which has its genesis in the 1952 Independent Offices Appropriations Act. Second, categorical exclusions (CEs) for OHV permitted events (and some other project level activities such as prescribed burns) are now required to have a public notice, a comment period, and a formal appeals process thanks to a 2005 court ruling.

According to BRC "... on July 2, 2005 the United States District Court for the Eastern District of California issued an Order banning the use of CEs. The ruling requires any forest project using a CE to include a formal public notice, be available for public comment and give the public the option of appealing the decision. The order applies to all decisions made with a CE after July 7, 2005. It also applies nationwide."

HQ believes tackling the many bureaucratic hurdles that face permitted OHV and other recreational events is an important task. Over recent years, we have seen many OHV events cancelled and/or postponed because of onerous regulations and red tape.

HQ believes that a congressional fix to this issue is the proper long-term solution. Several key tenets for legislative solutions could include the following:

COST RECOVERY/IOAA

“Exempt OHV permitted events from cost recovery on units that receive supplemental funding (e.g. state OHV grants, etc.)”

CEs
“Exempt CEs for OHV permitted events from public notice, public review, and a formal appeals process where said event uses designated roads, trails, and areas.”

With a new round of DEM and GOP Wilderness bills lurking in the background, this might be the perfect time to propose a fix for the recreation permit issue if there are to be any pro-access compromises offered in these bills as a way to move them forward. Also, we should do outreach to other user groups since they are being impacted too. I envision a bill with a lot of support from diverse recreational interests.

Marines' Johnson Valley DEIS is Flawed - Comments Due May 26!

As many of you know, the Marines at 29 Palms have proposed to expand their base of operations into the popular Johnson Valley OHV Area. Back in 2008 and 2009, a number of OHV groups, local governments, and other stakeholders challenged the premise of the proposal and wrote comments in strong opposition to the expansion.

In the 2009 BRC comment letter, the “need” for three Marine Expeditionary Brigades to train simultaneously was challenged. Another question was raised about why the Marines are developing a proposal based on an outdated segregated training model instead of looking at a 21st Century integrated training model? Also, the Marines were asked about how this proposal would be funded considering the current fiscal crisis and ballooning national deficit?

HQ’s initial impression after a quick review of the DEIS is that the agency has failed to answer the aforementioned questions. This proposal appears to have little to do with current and projected battlefield scenarios. Rather, this proposal appears to be politically motivated and has the same merit as a Navy Base Commander wanting to reactivate 3 battleships and then do a front-loaded expansion plan to support it. While that might have some emotional attraction, that plan would be just as irrelevant as the Marines claimed “need” to have three MEBs train together in what was once a popular recreation area.

Another process issue is that the scoping document did not daylight the DEIS’s post-scoping arbitrary decision criteria that was used to basically disqualify numerous public comments and ideas such as using other federal military facilities and reclassification or re-designation of other public lands.

HQ believes that the DEIS as presented is seriously, if not fatally, flawed. Those of you who commented should review your comments and point out to the Corps where you feel they missed the boat.

Again, HQ’s opposition should not be taken as a slight against our military. But rather as opposition to bad decision-making by federal officials. Please get your comments in by May 26, 2011.

BLM In NV to Ban OHV Events in Reno/Carson City Area?

Throughout the West there is a growing movement among some federal land management units to functionally ban OHV (and even some non-motorized) permitted events. Just recently, BRC’s, Don Amador, was contacted by the Reno Dust Devils Motorcycle Club regarding just such a case in the BLM Carson City Field Office.

In response to that request, a letter was written to Congressman Dean Heller asking him to review this issue.

Some of you may have been following a similar situation on the Eldorado National Forest where basically ALL permitted AMA sanctioned-events have been administratively banned.

As you know, a federal line officer (Forest Supervisor/Area Manager) has 100% discretion (without review or appeal rights) regarding the authorization of permitted events. If that line officer is biased against OHV events or if they have been threatened with an eco-lawsuit - by a vexatious litigant if they allow an event - it is quite easy for them to kill events by creating a mountain of red-tape or requiring a cost-prohibitive environmental planning document.

HQ is convinced that the long-term solution is for Congress to fix this issue with legislation that encourages OHV events at designated OHV areas, fishing derbies on fishing lakes, ski events at ski areas, and rock climbing competitions at popular rock climbing areas. The current regulatory atmosphere makes it all too easy for line officers that do not want permitted events on their units to simply create a red-tape hurdle that volunteer clubs cannot climb.

BLM/EPA Weighed in Scales and Found Wanting at Hollister Meeting

SRMC Member Points to CCMA Trails

Based on feedback from riders and club representatives who attended the OHMVR Commission meeting in Hollister yesterday, the BLM and EPA were weighed in the scales and found wanting. Very disappointing when riders showed up to view federal integrity and accountability and found none of those virtues on display.

HQ commends all those who showed up and continued to challenge the faulty science (even the BLM/EPA have said there were uncertainties from the beginning) used by the BLM as a poor excuse to effect the largest landscape level closure of its kind in U.S history.

HQ also commends the OHMVR Commission for voting (and showing accountability and integrity) to send a strong letter to Congress, elected officials, and government agencies. Among a number of questions, they will ask about the BLM/EPA’s continued determination to base the ongoing closure on flawed science and how that unexplainable stubbornness -- in the face of new science -- complies with the March 9, 2009

Knee Injury Hits HQ Last Week

As some of you know, The General suffered a major injury last Sunday (slipped in mud - not OHV related) while helping with some outside chores at his mom’s house. At about noon, he tore the quad muscle/tendon off the patella.

To make a long story short, TG had knee surgery on Tuesday and is Command Post bound (no filed trips or recon) for the next 6-8 weeks. HQ appreciates the get-well wishes that it already has received from OHVers in various locations.

During recovery, HQ will be up and running doing online land-use work, making phone calls, and performing other OHV access tasks that do not require attendance at events.

There are a lot of issues in play right now and those include CCMA, youth lead ban legislation/hearings, wild lands, OHV Trust Fund, FS Planning Rule, TMR, and cost recovery just to name a few.

Be assured HQ will post timely information and updates on these and other issues.

HQ should have an update later today regarding BRC comments to the OHV commission for the Hollister hearing tomorrow.

HQ WEEKEND UPDATE - Newspaper Highlights Raid on OHV Trust Fund

For the last several months, HQ has posted alerts, information, and narratives about government officials taking (some call it stealing) money from the user-pay/user-benefit CA OHV Trust Fund.

There have been hearings, letter writing campaigns, and other efforts to challenge the ongoing thefts from the OHV Trust Fund. There have also been a newspaper article or opinion piece or two on this subject but they have not clearly identified the OHV program as being completed user funded.

The goods news on the media front is that a local newspaper in the Lake Tahoe area got the story straight - for the most part -with interviews from the BRC, Tahoe Sierra OHV Club, and OHMVR Division.

HQ believes this report validates the OHV community’s concerns that the closure at CCMA was politically motivated and was a gross abuse of federal power by a government agent.

HQ blogged back in Jan. 15, 2010 that the BLM and EPA should be ashamed of themselves for foisting an unwarranted 70K acre landscape level closure on the American People.

HQ believes this closure has caused great harm to local users, businesses, and the community. OHV dealerships have closed. There is no excuse for this behavior and this abuse of power by government officials should be the object of a Congressional inquiry or hearing. Rick Cooper, the BLM Area Manager, told me on several occasions that he made the decision NOT to review options or management tools that would allow for CCMA to remain open. As the report states, there are many activities that occur on public lands that are far more dangerous. Yet, you have a government official that went out of his way to exclude any options to keep CCMA open.

HQ believes this issue has gone beyond the Hollister Field Office and will most likely be addressed by BLM Director Bob Abbey with input from county officials, OHV users, recreation organizations, gem collectors, Congress, and the OHV Division.

Stay tuned for more updates, as it appears the CA OHV Commission will have a hearing on this issue on April 5 in Hollister, at the Veterans' Hall on 649 San Benito Street just a few blocks from the San Benito County Board of Supervisors Office. The county officials have been real heroes in this fight as well.

As some of you are preparing for the upcoming Forest Service Planning Rule meetings next week, HQ wanted to give you some background information on this issue. The public meetings next week (with no opportunity for formal public comment) are simply a way for the agency to comply with NEPA requirements (and spend a lot of taxpayer monies that could be used for more practical efforts such as trail maintenance, trail planning, or do the required NEPA for permitted events).

HQ’s initial impression from reading the DEIS is it basically ignores the agency’s congressionally directed multiple-use mandate and makes that historic agency mission subservient to “preservation” and ecological sustainability. Also, the plan’s self-imposed requirements to maintain species viability will trump traditional multiple-uses.

Lastly, there are a lot of new terms that have not been legally or congressionally defined (e.g.. connectivity, ecosystem diversity, sustainable recreation, viable species population, etc) that will set the agency up for an avalanche of taxpayer-funded eco-lawsuits.

Again, HQ believes that traditional multiple-uses of public lands (recreation, timber, grazing, permitted events and activities, etc.) will be trumped by, and made subservient to, environmental tenets if a different (pro multiple-use) alternative is not selected.

HQ UPDATE - OHVers Testify at March 14 OHMVR Commission Meeting

The Recreation HQ wants to thank all members of the OHV family for attending the special OHMVR Commission meeting yesterday in Sacramento. HQ believes the commission admirably fulfilled its duty to represent OHV recreation by taking public testimony from a wide array of interests.

This was the best attended commission meeting in the last 3 years and it showed the high level of concern by the OHV community regarding the $10 million dollar “shift” out of the OHV Trust Fund to the General Fund and the potential loan of $21 million dollars from the OHV Reserve Fund.

HQ noted four reoccurring themes in most of the public testimony and commission comments.

1 – Stealing money from the OHV Trust Fund violates the public trust
2 – Stealing money from the OHV Trust Fund is a double tax
3 – Stealing money from the OHV Trust Fund is illegal
4 – Stealing money from the OHV Trust Fund violates the legislative intent of SB742

After an hour or two of public testimony the commission voted to send a letter to the Governor and legislature regarding their opposition to taking the money which violates the public “trust” in the Trust Fund. They are also going to send a letter seeking to resolve the fungible issue based on what many feel is an illegitimate decision made by the Legislative Analyst’s Office in 2009.

After taking a short break, the commission reconvened and took additional public comment on non-agenda issues. BRC’s Don Amador updated the commission on some recent developments regarding Clear Creek. Those updates and issues included the congressional hearing last week where the BLM Director was asked about the closure of Clear Creek, the commission and public should receive an update or status report on the OHMVR Division’s Asbestos Study, and the FEIS is on the brink of being published in the Federal Register.

HQ believes the commission is considering a meeting in the Hollister area in the next 3-4 weeks to review the Clear Creek issue. That is a good thing.

OHV ALERT - Attend Special OHV Commission Meeting on March 14 in Sacramento

As most HQ followers already know, government officials are once again proposing to “shift” (don’t know if it is loan or a take) $10 million dollars ($5 million from grants and $5 million from Division) out of the OHV Trust Fund. Also, there is a proposal to “sweep” (don’t know if it is loan or take) $21+ million dollars out of the OHV Reserve Fund.

Because of the thousands of letters and phone calls from extremely frustrated (some are even angry) OHV enthusiasts to your elected officials, park staff, and the OHV Commission, the Commission has scheduled a special meeting/hearing on this issue for Monday, March 14, 2011 in Sacramento.

HQ does not usually urge riders to take time off work or make a special trip (however thanks to those of you who do attend regular meetings) to attend regularly scheduled OHV commission meetings, but this is of such a critical nature that HQ is making a formal request for attendance to those who will be impacted by the shifting of funds out of the OHV program. Those affected stakeholders include OHV enthusiasts, FS/BLM recreation staff and law enforcement officers, county parks, local sheriff departments, search and rescue teams, county park departments, local police departments, and many others.

Missoula Court Cites 9th Circuit Victory

Several riders have contacted the HQ asking about any updates on the impact of the 9th Circuit Court of Appeals’ decision to strike down the federal defendant rule on January 14, 2011.

In answer to that question, HQ is proud to report the Missoula Division of the U.S. District of Montana Court recently granted intervention “as of right” (a legal term) to recreation interests and cited the 9th Circuit decision. This is notable because the same Court has historically been liberal in allowing intervention by all interested parties, but has done so via permissive intervention.

CA OHV Program Takes $10 Million Dollar Hit - The Fight Continues

The Recreation HQ wants to thank all of you who sent in letters, made phone calls, and attended meetings. As you know, there was an effort to gut the entire CA OHV Program. That reality could have closed SVRAs, shut down the Division, and ended the grants program.

Over the last 3 weeks, you let your legislators know that you did not want them to steal money from one of the very few successful user-pay/user-benefit programs in the state. You also asked them to put the “Trust” back in the OHV Trust Fund.

Based on the vote yesterday by the Budget Conference Committee... that group appears to have heard your voice. As some of you know, they voted to “shift” $10 million dollars out of the OHV Trust Fund ($5 million from the grants program and $5 million from the Division/Support program). We will have to see if "shift" means a loan or a take.

Based on the fact that we were looking at a complete annihilation of the OHV program, HQ feels this is somewhat of a victory. However, we need to be careful about calling it a victory because the war against the OHV program is far from over. We have yet to see if the Governor will actually sweep out $21 million dollars from the OHV reserve fund.

Also, other attacks against the program could occur between now and when the Governor signs this budget later this spring. I think it is interesting that we have not seen the “list” of proposed state park units that will be closed. My feeling is that state parks was waiting to see how much they could steal from us before posting that soon to be infamous list of park closures.

As it stands right now according to my best analysis… here is what the OHV program looks like for the 2010-2011 budget (remember the Gov. and legislature will have to fight over the 2011-2012 budget in a few months).

$22 million for the Grants Program

What Interior/BLM's Wild Lands Plan Means for Rural Economies

HQ wants to commend all the recreationists who sent letters over the last two days to Congress regarding the BLM’s Wild Lands policy. As some of you know, the creation of de facto Wilderness by federal agencies is not our only problem. Throughout the West, OHV clubs are being forced to cancel traditional motorized permitted events because the BLM and FS are now charging up to $50,000 dollars or more for these group activities.

Historically, the agency used to charge only a minimal fee or an appropriate percentage of the gross receipts largely because of the economic benefit it brought to the local community and that hosting public events was part of their congressionally directed multiple-use mandate.

As you might have seen in the Wild Lands hearing yesterday, the BLM admitted it does not have the statutory authority to eleveate the creation of de facto Wilderness above other uses.

“Chairman Bingaman, thank you for scheduling this hearing.

“Before we begin, I would like to note with sadness the recent passing of former Chairman Jim McClure. Chairman McClure’s strong work ethic and sense of fairness is a vital part of this Committee’s legacy. He was one of a long line of chairmen who have sustained the tradition of the Energy Committee as forum for the fair consideration and resolution of serious policy debates that continues to this day. I would like to extend my sympathy to his family and many friends. He will not be forgotten, but he will be greatly missed.

“Secretary Salazar, thank you for being here to discuss the President’s proposed budget for Fiscal Year 2012. Much has changed in our nation’s political landscape and in the international arena since the last time you testified here. And I must say – I’m deeply concerned that the budget proposal before us today seems to be from that time.

“Many of the Department of the Interior’s recommendations ignore our current reality – among other things, a $1.6 trillion dollar federal deficit, and rising unrest that has spiked oil prices to the point where our economic recovery could be threatened. Instead of addressing those challenges, the Department is seeking to expand the role and “footprint” of the federal government, increase taxpayers’ liability for maintenance, and place more land off limits to recreation and resource exploration.

“There are a few things I would like to specifically address here today. First on my list is the Department’s new “Wild Lands” policy. Your Order has vast potential to lock up and limit access to lands throughout the country, but particularly in Alaska, where two-thirds of our land is owned by the Federal Government.

“On its face, the “Wild Lands” policy appears to be a workaround of limitations in the Wilderness Act. Interior has also specifically stated that BLM land which was previously dedicated for a specific purpose, like the National Petroleum Reserve-Alaska, will be reevaluated and could be designated as “Wild Lands”. So it appears that Interior not only wants to take control over land designations away from Congress, but also intends to review and perhaps overrule past congressional decisions.

“There are serious questions about the wisdom of the proposed increases in so many taxes and fees, across the board, on the energy companies we’re responsible for regulating, and whether that’s really more likely to result in the law being carried out in the expeditious manner Congress has demanded. Given the deeply troubling situations in Libya, Bahrain, and Iraq, there is little, if any, patience for continued delay in bringing back our American energy production and the associated jobs.

“Another proposal that seriously troubles me is the full funding of the Land and Water Conservation Fund under the category of the America’s Great Outdoors initiative. Given the pressing need to balance our budget, I have to question this spending. Each land management agency within the Department of the Interior already has a sizeable maintenance backlog. The National Park Service alone is at $9 billion. If we cannot afford to manage the land that we already have entrusted to the federal government, then it is irresponsible to acquire more.

“Finally, on a more parochial note, I am very concerned that the Department has recommended a 54 percent reduction in the Alaska Conveyance Program. This program, which is required by the Alaska Land Conveyance Acceleration Act of 2004, works to fulfill the promise made to Alaska’s Native people when Alaska entered the union. It has been 40 years since the original law was signed. With the funding that was provided to the BLM last year, you suggested it would take another 20 years to complete the conveyances.

“Given that most of those people waiting for their conveyances will now have to wait 40 to 50 more years at this proposed funding level, I’m not only going to ask you to explain this choice here, today – I’m also going to ask you to come to Alaska and explain to the people who have waited patiently for so many years why they should now wait forty or fifty more.

“Secretary Salazar, you have certainly lived in interesting times since you became Secretary of the Interior. You have been presented with many difficult dilemmas. I know many of the members of this Committee share my concerns, so I look forward to hearing your side of the story and discussing these issues with you in greater detail.”

As permitted motorized events continue to be cancelled throughout the West because of exorbitant and unwarranted user fees, the Recreation HQ believes that it is important for access interests to remain engaged in the fight to protect our access rights. Recreationists should continue to work with Congress to challenge those excessive “cost recovery” fees.

HQ remembers when the modern version of TMR was born. That event -- which has turned into a land-use version (circa 2002-2003) of “Rosemary’s Baby” -- came out of an idea hatched between wilderness advocates (who were in charge of the CA OHV Commission at the time), the FS, and even some in the OHV community.

TMR even in its early stages was never sold to the OHV community as a program to effect landscape level closures. Yet it somehow morphed into plans that on some Forests have resulted in 100 percent closures or closures of thousands of miles of historic roads and trails on other units.

HQ applauds Congressman Steve Pearce and the public land access interests in New Mexico for standing up against a program that has really nothing to do with “land management” but in many cases is simply a political decision made to champion the closure agenda of extreme environmental groups.

I write to you today as a California native and a strong supporter of the California Off-Highway Vehicle (OHV) Program. And, I urge you not to betray the public “trust” again by illegally taking user-pay/user-benefit monies from the OHV Trust Fund.

As a teenager in the late 1960s-70s, I remember filling out a state gas tax refund form where I got a refund from the state treasurer based on the amount of fuel I used when driving my OHV off-road (non-paved dirt roads). I also remember the promise made to me by the proponents of the Chappie-Z’berg Act of 1971 (that established the California OHV Program) that they would use these dedicated “trust” funds to manage motorized recreation. I trusted them.

Over the years, that trust has been betrayed on a number of occasions by both Republican and Democrat officials. In fact, there have been two lawsuits filed by the OHV community that successfully challenged the state government’s legal authority to raid the OHV Trust Fund.

As a member of the negotiating team (OHV, environmentalists, legislature, Governor’s Office) that met throughout the summer of 2007 to hammer out SB742 (the new OHV Program), I remember the group worked hard to make sure that protecting the “trust” in the OHV Trust Fund was a key statutory tenet of that legislation.

Today, I urge your committee to not betray the public-trust again by taking OHV money that is not yours to take.

DEFCON ONE Alert to CA OHV Community - Stop Weekend Raid on OHV Trust Fund

CA OHV COMMUNITY PLACED ON DEFCON ONE ALERT STATUS THRU WEEKEND

After the California Budget Conference Committee’s discussion today about the fiscal future of the CA OHV Program, the Recreation HQ is issuing its first DEFCON ONE ALERT.

Folks, the Committee postponed a vote to steal the money today but will be meeting between now and over the weekend until they decide how much money they want to take from the OHV Trust Fund. I heard from one government staffer who witnessed bogus testimony from the California Legislative Analyst’s Office staff about how they have a right to steal dedicated funds. This person said it was the most embarrassing display of bad government they had ever seen.

HQ believes these proposals to steal money from the OHV Program is a gross violation of the public trust and betrays both the spirit and intent of SB742. How can they ever ask the OHV community and OHV leaders to work with them in a collaborative manner if they do this? Nobody I know will ever trust them including me.

This DEFCON ONE ALERT is being issued because HQ believes that both the Grants Program (trails, restoration, law enforcement, and safety) and the Division (SVRAs, grant staff, scientists, other professionals) are now both equally at risk (before they had just talked about gutting the Division side of the program).

HQ is asking that you share this information with your local county supervisors, sheriffs, FS, BLM, and other grant recipients and ask them to contact the Budget Conference Committee Members AND their own Assembly members, State Senators, and Governor to petition them to honor the OHV Trust Fund. It will be the rural counties and users that get hurt the most if the OHV Trust Fund is sacked.

As many of you know, the Shasta-Trinity National Forest is wanting to develop a formal OHV recreation program to work on post-subpart B trail projects that were not part of the original TMR subpart-B planning effort.

STOP What You Are Doing and SEND Letter NOW

Since early in 2009, the Recreation HQ has posted a number of blogs regarding the functional ban by government agencies on the sale of youth sized OHVs. Fortunately, the Motorcycle Industry Council has been at the forefront of an effective national campaign to have Congress resolve this issue.

Currently, there is a bill in Congress - H.R. 412 - that offers a legislative fix to this mess. This ban has not only hurt families who like to ride together but it has been a contributing factor to many dealerships going out-of-business.

Please take a few minutes to watch the video and then click on the email link to send a letter to Congress urging them to solve this issue.

I sent my letter in this morning just before posting this blog. HQ urges you to send a letter as well and forward this alert to your entire email network.
